APPROVE OF SECOND AMENDED REAL PROPERTY LEASE WITH FOGERTY ICE ARENA

Background

In August the City Council adopted an amended lease with Fogerty Ice Arena that altered the legal description of the property to be leased from the City to Fogerty Ice Arena in order to include the property where the new Curling Facility is being built.  The lease also had a provision that referenced a repayment agreement for the City's costs associated with moving an athletic field.  

At the August 9^th workshop meeting the City Council discussed the repayment amount with Mark Clausen representing the Fogerty Ice Arena.  The Council consensus was to amend the repayment amount originally discussed from $210,000 to $175,000.  This second amended lease reflects the new repayment amount.

Recommendation

By motion, approve of Second Amended Real Property Lease with Fogerty Ice Arena.
