The applicant is requesting a Conditional Use Permit (CUP) to allow for online purchase pick-up. Similar to previous requests, conditions have been added to ensure the use does not adversely impact neighboring businesses and traffic.

Zoning

The property is zoned I-1 (Light Industrial). The online purchase pick-up location is a conditional use in the zoning district.

 

Surrounding Zoning and Land uses

Surrounding properties are zoned I-1 and guided for light industrial.

 

Existing Conditions

A building exists on the property with four tenant spaces. Suite 120 is used by Daas LLC for wholesale shipping and receiving.

 

History

The building was constructed in 1986. No previous land use approvals have been granted.

 

Evaluation of Request

Daas LLC purchases overstock goods and resells them, typically in a wholesale fashion. Due to difficulties in shipping and receiving, the applicant would like to be able to also utilize online auctions for the sale of excess products.

 

Online purchase pick-up location was added as a conditional use permit to the industrial zones as part of the 2020 zoning code revision. A CUP is required to ensure that parking is adequate for the proposed use and that the potentially large quantity of traffic does not adversely impact neighboring properties and businesses.

 

The applicant has indicated that auctions would not be held on a regular basis and pick-up would be on the weekend. This would avoid impacts to neighboring businesses.

 

Conditions have been included in the attached resolution obligating the operator to modify pick-up procedures, if needed, to prevent impact to the surrounding businesses from traffic, parking, and circulation issues.

 

Site Plan

The site meets the setbacks and landscaping requirements for the I-1 zoning district. No changes to the site are proposed as part of this project.

 

Architecture

The existing building was constructed of textured concrete. No modifications are proposed or required.

 

Landscaping

The site is required to have 19 trees to meet landscaping requirements. The site has over 19 trees, so the requirement has been met.

 

Grading/Storm Drainage

Given that the proposed CUP has no associated proposed construction, there will be no changes to the grading or storm water drainage of the area.

 

Utilities

Given that the proposed CUP has no associated proposed construction,

no new water or sanitary sewer services will be required.

 

Wetlands/Watershed/FEMA

Given that the proposed CUP has no associated proposed construction, there are

no additional wetland, watershed or FEMA requirements.

 

Access/Street Design/Sidewalks/Trails

Given that the proposed CUP has no associated proposed construction, no additional access points, street design, sidewalks or trails will be required

 

Easements/Right-of-Way/Permits

The developer will need to obtain all required permits to construct the proposed project. A copy of all permits will need to be submitted to the City prior to any site work.

 

Conditional Use Permit

Section 27.04 Criteria for granting conditional use permits:

The Blaine City Council shall consider the advice and recommendations of the Planning Commission and the effect of the proposed use on the comprehensive plan and upon the health, safety, and general welfare of occupants of surrounding lands. Among other things, the Council shall consider the following findings where applicable. (Ord. No. 20-2447, 7-20-2020)

 

1.                     The use shall not create an excessive burden on existing parks, schools, streets and other public facilities and utilities which serve or are proposed to serve the area. The infrequency of pick-up events and the timing on the weekends will prevent any potential burden on roads.

2.                     The use will be located, designed, maintained, and operated to be compatible with adjoining properties and the existing or intended character of the zoning district. The use is compatible with adjoining properties and the infrequency and timing of pick-up events will ensure compatibility.

3.                     The use shall have an appearance that will not have an adverse effect upon adjacent properties. No change in appearance is proposed.

4.                     The use, in the opinion of the City Council, shall be reasonably related to the overall needs of the City and to the existing land use.

5.                     The use shall be consistent with the purposes of the zoning code and purposes of the zoning district in which the applicant intends to locate the proposed use. The I-1 district is intended to provide for a variety of industrial uses without allowing for objectionable elements. The proposed use meets that intent.

6.                     The use shall not be in conflict with the comprehensive plan of the City. The proposed use falls within the light industrial land use in the comprehensive plan.

7.                     The use will not cause traffic hazard or congestion. The proposed use will not result in any additional traffic hazards or additional congestion to the area.

8.                     The use shall have adequate utilities, access roads, drainage and necessary facilities. The proposed use will have the required utility services, adequate roads and necessary drainage facilities to service the proposed use.

The public hearing is being held at the City Council meeting, therefore no review or

recommendation was received from the Planning Commission.

Body

                     WHEREAS, an application has been filed by Daas LLC as Conditional Use Permit Case File No. 22-0053 for Daas LLC Online Auctions; and

 

                     WHEREAS, said case involves the property described as follows:

 

Lot 6 Block 2 BURR OAK INDUSTRIAL PARK

                     

                     WHEREAS, the Blaine City Council held a public hearing on August 15, 2022,  regarding said Conditional Use Permit; and

 

                     WHEREAS, the Blaine City Council has reviewed said case on August 15, 2022; and

 

                     WHEREAS, the criteria identified in Section 27.04 for granting a conditional use permit has been met.

 

                     NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that a conditional use permit is hereby approved per Section 31.04 (b) and 27.04 of the Zoning Ordinance to allow for online purchase pick-up in an I-1 (Light Industrial) zoning district with the following conditions:

1.                     No more than one pick-up event may occur per week.

2.                     Pick-up events shall be scheduled for weekday evenings or weekends.

3.                     Any inspection of items by potential bidders must be arranged by appointment.

4.                     The applicant is required to manage parking demand by expanding pick-up timeframes or otherwise modifying procedures, if necessary, to reduce the parking need at any particular time.

5.                     The applicant is required to manage circulation to ensure access to other tenant spaces in the building is maintained through the use of directional signage, directing traffic within the parking lot, and/or modifying pick-up procedures if necessary. No expansion of the use beyond Suite 120 is allowed without an amendment to this conditional use permit.

6.                     No outside storage is permitted except for vehicles associated with the warehousing uses as allowed by 31.22 (b), not to exceed one truck per dock or bay door.
