Executive Summary

The applicant is requesting an amendment to a conditional use permit issued in 2021 for an apartment building. The amendment would allow a pickle ball court to be constructed on the west side of the approved apartment building.

Zoning/Land Use

The property is zoned PBD (Planned Business District) and has a land use of HDR/PC (High Density Residential/Planned Commercial).

 

Surrounding Zoning and Land uses

The parcels to the north, south and east have the same land use and zoning as the independent living apartment building. The property to the west is zoned DF (Development Flex) and has a land use of LDR (Low Density Residential).

 

History

The applicant received approval in October 2021 for the construction of a 184 unit-55+ independent living apartment building. A building permit was issued in July and site work has begun.

 

Evaluation of Request

The applicant is proposing to add one pickle ball court on the west side of their independent living apartment building. The proposed pickle ball court will be enclosed by a black six (6) foot tall decorative fence. The pickle ball court is proposed to be approximately 85 feet from the west property line.

 

Grading/Storm Drainage

The pickle ball court is proposed for an area within the existing proposed development. No additional grading or storm water drainage changes will be required.

 

Utilities

The pickle ball court is proposed for an area within the existing proposed development. No new water or sanitary sewer services will be required.

 

Wetlands/Watershed/FEMA

The pickle ball court is proposed for an area within the existing proposed development. There are no additional wetland, watershed or FEMA requirements.

 

Access/Street Design/Sidewalks/Trails

The pickle ball court is proposed for an area within the existing proposed development. No additional access, street design, additional sidewalks nor trails will be required.

 

Easements/Right-of-Way/Permits

The developer will need to obtain all required permits to construct the proposed project. A copy of all permits will need to be submitted to the City prior to any site work.

 

Conditional Use Permit

Section 27.04 Criteria for granting conditional use permits:

The Blaine City Council shall consider the advice and recommendations of the Planning Commission and the effect of the proposed use on the comprehensive plan and upon the health, safety, and general welfare of occupants of surrounding lands. Among other things, the Council shall consider the following findings where applicable. (Ord. No. 20-2447, 7-20-2020)

 

1.                     The use shall not create an excessive burden on existing parks, schools, streets and other public facilities and utilities which serve or are proposed to serve the area. The pickle ball court will not create an excessive burden on parks, schools, or streets. The court addition will provide a recreation option for the residents of the apartment building.

2.                     The use will be located, designed, maintained, and operated to be compatible with adjoining properties and the existing or intended character of the zoning district. (Ord. No. 20-2447, 7-20-2020) The pickle ball court is being located with an 85-foot setback and enclosed with a decorative fence. Therefore, the use will be compatible with the adjoining property.

3.                     The use shall have an appearance that will not have an adverse effect upon adjacent properties. The pickle ball court is being enclosed with a decorative fence and landscaping planted adjacent to the court. The appearance of the pickle ball court will not have an adverse effect on adjacent properties.

4.                     The use, in the opinion of the City Council, shall be reasonably related to the overall needs of the City and to the existing land use.

5.                     The use shall be consistent with the purposes of the zoning code and purposes of the zoning district in which the applicant intends to locate the proposed use. The intent of the PBD (Planned Business District) is to provide opportunity for greater flexibility in arranging land uses according to relative compatibility, convenience, and community needs. The addition of the pickle ball court provides a conveniently located recreation opportunity.

6.                     The use shall not be in conflict with the comprehensive plan of the City. The use is not in conflict with the HDR/PC (High Density Residential/Planned Commercial) designation in the Comp Plan.

7.                     The use will not cause traffic hazard or congestion. The use will not result in any additional traffic hazards or additional congestion to the area.

8.                     The use shall have adequate utilities, access roads, drainage and necessary facilities. The proposed use, once constructed, will have the required utility services, adequate roads and necessary drainage facilities to service the proposed use.

recommendation was received from the Planning Commission.

Body

                     WHEREAS, an application has been filed by Roers Companies as Conditional Use Permit Amendment Case File No. 22-0049 for Blaine Risor Apartments; and

 

                     WHEREAS, said case involves the property described as follows:

Lot 3 Block 1 BLAINE HY VEE

                     

                     WHEREAS, the Blaine City Council held a public hearing on August 15, 2022, and

 

                     WHEREAS, the Blaine City Council has reviewed said case on August 15, 2022; and

 

                     WHEREAS, the criteria identified in Section 27.04 for granting a conditional use permit amendment has been met.

 

                     NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that a conditional use permit amendment is hereby approved per Section 30.50 and 27.04 of the Zoning Ordinance to add an outdoor pickleball court to the Blaine Risor Apartment property in a PBD (Planned Business) zoning district with the following conditions:

 

1.                     The fence enclosing the pickle ball court should be no more than 6 feet in height and a decorative style fence.

2.                     All other items referenced in Resolution No. 21-195 remain unchanged.
