Executive Summary

The Joint Powers Agreement will allow the portion of Hamline Avenue from 97th Lane to Edgewood Road, which lies within the City of Lexington, to be reconstructed as a part of the City of Blaine Hidden Oaks Area Street Reconstructions, Improvement Project 22-06.

 

Background

At the September 20, 2021 Council meeting, the City Council ordered the preparation of a feasibility report for the Hidden Oaks Area Reconstructions project. 

 

Prior to preparation of plans and specifications, a Joint Powers Agreement (JPA) between the the City of Blaine and the City of Lexington has been prepared to clarify such things as division of cost, design, contract administration responsibilities and other miscellaneous details. 


The City of Lexington approved the JPA at the January 20, 2022 City Council meeting and has forwarded the signed JPA to the City of Blaine for consideration by the Council.

 

The main points of the JPA are as follows:

 

                     All construction costs for the project, will be split between Blaine and Lexington based on each City’s percentage of the front footage along the project corridor, except driveway and curb and gutter which will be apportioned based on actual costs of driveway and curb and gutter installed in each city respectively.

                     Blaine will provide all survey, engineering design and project administration services for the project.  Costs for said services will be paid for by Blaine. The inclusion of the City of Lexington portion of Hamline Avenue in the construction plans will result in a negligible amount of time spent by the consultant engineer.  The design will simply mirror what is being designed for the City of Blaine side of the road.

                     Construction inspection shall be a joint effort between the parties, led by Blaine.

                     Each city shall perform all resident coordination with their own residents regarding any issues associated with the project.

                     Lexington staff will be included in determining the general scope and design parameters of the project and will inspect the construction as necessary to ensure the project meets the City of Blaine standards.

                     Both cities shall approve the final design prior to bidding of the project.

 

It is recommended that both cities share the responsibilities and costs as outlined in the attached JPA.  If the JPA is approved by Council, staff will have the consultant engineer include the City of Lexington portion of Hamline Avenue in the construction plans.

The project aligns with the City’s strategic initiatives for Growth Management and providing a well-maintained Infrastructure.

Financial Impact

The financial impact is outlined per the JPA with all costs for the construction of the City of Lexington’s portion of Hamline Avenue paid for by the City of Lexington.  The City of Blaine will incur no additional costs if the JPA is authorized by Council.

Body

                     WHEREAS, the City of Lexington and the City of Blaine desire to jointly reconstruct a section of Hamline Avenue from the intersection at 97th Lane to the intersection at Edgewood Road for the benefit of the traveling public; and

 

                     WHEREAS, Minnesota Statutes Section 471.59 authorizes the City of Lexington to enter into an Agreement with the City of Blaine to provide for the reconstruction of Hamline Avenue from 97th Lane to Edgewood Road for the joint exercise of powers common to each; and

 

                     WHEREAS, said Agreement details the responsibilities of the City of Lexington and the City of Blaine as to the costs associated with the design, construction and related activities of the project.

 

                     NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine as follows:

 

1.                     Joint Powers Agreement between the City of Lexington and the City of Blaine with regard to the reconstruction of a section of Hamline Avenue from 97th Lane to Edgewood Road is hereby approved.

2.                     The Mayor and City Manager are hereby authorized and directed to execute said agreement, and any amendments, and thereby assume for and on behalf of the City of Blaine all of the contractual obligations contained therein
