Council is asked to approve amended on-sale and Sunday intoxicating liquor licenses that would allow the consumption of alcohol in the adjacent nail salon.
Background
In 2020, Quan Nguyen opened two new businesses at 11712 Ulysses Lane NE: Best Taste of Pho Saigon, Suite 200, and Vertex Nails Salon, Suite 100. While both businesses were owned by Mr. Nguyen, he established two separate corporations: Best Taste of Pho Saigon, Inc. and Vertex Nails Salon, Inc. Statute allows for the sale and consumption of alcohol only by the approved license holder, which was Best Taste of Pho Saigon, Inc. As Mr. Nguyen wants to offer alcohol service to customers of the salon as well, he is requesting approval of a merger of the two corporations. He has provided staff with articles of merger between Best Taste of Pho Saigon Inc. and Vertex Nails Salon Inc., an updated certificate of liquor liability insurance, amended and restated lease for commercial property, updated floor plan outlining the new licensed premise, and updated liquor service policy. Staff has confirmed that a new entity has not been formed and that Best Taste of Pho Saigon Inc. remains as the approved liquor license holder as well as the responsible party. If approved the updated license premise information will be forwarded to MN State Alcohol and Gambling for their records.
