Executive Summary

The applicant is requesting approval of a final plat for a two-lot subdivision adjacent to the recently completed Cedar Green Apartments. The final plat is consistent with the approved preliminary plat and the subdivision and zoning ordinances.

Background

In 2001 a preliminary plat was approved for Lunde Estates which subdivided a 1.9 acre site into five lots. The final plat included three lots and left two as an outlot since they were not served by city sewer and water and did not have paved frontage.

 

The construction of Cedar Green Apartments included extending water to the outlot and constructed a paved cul-de-sac (Pierce Ct). Therefore, the property owner of the outlot is seeking final plat approval at this time to create two buildable lots from the outlot. Sanitary sewer will be required to be extended south from 117th Ave NE along the rear property line to serve the two new parcels. The developer will need to dedicate a 20-foot drainage and utility easement on the west property line to accommodate the sewer extension. 

 

The proposed lots are 75 feet in width, which is less than the 80 feet required by the code in the R-1 district. The lots have a depth of 146.65 feet, exceeding the required depth of 125 feet. The lots are 10,950 square feet in area, exceeding the 10,000 square foot minimum lot area. Since the depth and area are exceeded, staff recommends approval of the lots with the narrower width as was approved with the preliminary plat in 2001. This is consistent with previous approvals elsewhere in the R-1 district.

 

Two front yard trees of at least 2.5 caliper inches are required in the front yards of each lot to meet the R-1 landscaping standards. The lots are currently wooded and compliance with the city tree preservation ordinance will be reviewed at the time of building permit. No tree removal may occur prior to approval of the tree preservation plan by the City Forrester.

 

The final plat is consistent with the approved preliminary plat, Resolution No. 01-110.

Body

                     WHEREAS, an application has been filed by George G. Lunde Trustee, as subdivision Case No. 21-0083; and

 

                     WHEREAS, said case involves the division of land in Anoka County, Minnesota, described as follows:

 

Outlot A, LUNDE ESTATES, Anoka County, Minnesota

 

                     WHEREAS, the Blaine City Council granted preliminary plat approval on June 25, 2001 subject to the stipulations as contained in Blaine City Council Resolution No. 01-111; and

 

                     WHEREAS, the applicant has submitted a final plat in general conformance with the approved preliminary plat.

 

                     NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that final plat approval for Lunde Estates Second Addition per Section 74-43 of the subdivision regulations is hereby granted subject to the following conditions:

 

1.                     Park dedication is required for the two new lots being proposed within the plat. The City’s current park dedication rate for single-family lots is $4,449 per unit (2021 rate). A total park dedication fee of $8,898 will become due prior to final plat mylars being released to the developer for recording at Anoka County.

2.                     Developer to obtain a permit from Coon Creek Watershed District prior to city plan approval.

3.                     Two front yard trees of at least 2.5 caliper inches are required for each lot. The tree preservation standards of 33.09 (a) (3) (cc) apply and shall be reviewed as part of the building permit. No tree removal shall occur until the tree preservation plan has been approved by the City Forester.

4.                     Standard WAC (Water Access) and SAC (Sewer Access) fees will be due with each home constructed.

5.                     Execution and recording of a Development Agreement outlining the developer responsibilities for the extension of the sanitary sewer along the rear property line is required prior to any building permit approval.

6.                     A twenty-foot-wide drainage and utility easement shall be dedicated along the western property lines in addition to the standard easements shown on the submitted final plat for the front and side lot lines.

7.                     The Mayor, City Clerk and City Manager are hereby authorized to execute any and all necessary documents, agreement and releases related to the approval, recording or administration of Lunde Estates Second Addition.
