Executive Summary
This is a request from Wellington Management, Inc. to release an old development agreement from the title for the Lexington Meadows development. The old development agreement no longer applies to Outlot A Lexington Meadows 2nd Addition.

The City is requested to release specific lots from recorded development agreements on a fairly regular basis. In this instance, the developer of Lexington Meadows 2nd Addition has requested that the City release Outlot A, Lexington Meadows 2nd Addition from the recorded development agreements for Lexington Meadows and Lexington Meadows 2nd Addition.
A portion of the outlot in question is being purchased for Lexington Meadows Medical Office building. All of the development agreement responsibilities for this lot have been met and the lot can be released. Lexington Meadows Medical Office will submit a Site Improvement Performance Agreement (SIPA) and financial guarantee to cover the cost of the site work specific to their site prior to any work being performed on the site.
The City Council must adopt a resolution that authorizes the Mayor and City Clerk to execute the release.

WHEREAS, Outlot A, Lexington Meadows 2nd Addition, is subject to a recorded Development Agreement and;
WHEREAS, the property owner has requested the City to release said lot from the recorded development agreement recorded as Document No. 2211134.007 Abstract (recorded October 10, 2018) and Document No. 2240460.004 Abstract (recorded October 3, 2019) and;
WHEREAS, the City has determined that there are no outstanding development issues related to said lot and therefore no further purpose for the agreements.
NOW, THEREFORE, BE IT RESOLVED, that the Blaine City Council authorizes the Mayor and City Clerk to execute all necessary documents releasing said Development Agreement for the following described property:
Outlot A, Lexington Meadows 2nd Addition
PASSED by the City Council of the City of Blaine this 20th day of September, 2021.
