Resolution Approving State of Minnesota Joint Powers Agreements with the City of Blaine on Behalf of its City Attorney
Executive Summary
Minnesota Government Access (MGA) provides electronic access to appropriate court records and documents for government agencies through login accounts for the individual agency users. In order to access Minnesota Court Data Services, the attached Joint Powers Agreements must be signed and a Court Data Services Subscriber Amendment to the CJDN Subscriber Agreement.

Access to Court Data Services provides for efficient performance of duties required or authorized by law or court rule. This is in connection with any civil, criminal, administrative, or arbitral proceeding in any Federal, State, or local court or agency or before any self-regulatory body.

Financial Impact
The city pays a quarterly CJDN Access Fee of $1,110 to the MN Bureau of Criminal Apprehension, which is allocated in the City Budget.

Staff Recommendation
By motion, adopt the resolution authorizing the Mayor, City Manager and City Clerk to sign the State of Minnesota Joint Powers Agreements Master Subscriber Agreement for Minnesota Court Data Services for Governmental Agencies and authorize the Mayor, City Manager and City Clerk to sign the Court Data Services Subscriber Agreement to CJDN Subscriber Agreement.

Body
WHEREAS, the City of Blaine on behalf of its Prosecuting Attorney and Police Department desires to enter into Joint Powers Agreements with the State of Minnesota, Department of Public Safety, Bureau of Criminal Apprehension to use systems and tools available over the State’s criminal justice data communications network for which the City is eligible. The Joint Powers Agreements further provide the City with the ability to add, modify and delete connectivity, systems and tools over the five year life of the agreement and obligates the City to pay the costs for the network connection.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of Blaine, Minnesota as follows:
1. That the State of Minnesota Joint Powers Agreements by and between the State of Minnesota acting through its Department of Public Safety, Bureau of Criminal Apprehension and the City of Blaine on behalf of its Prosecuting Attorney and Police Department, are hereby approved.
2. That the Police Chief, Brian Podany, or his or her successor, is designated the Authorized Representative for the Police Department. The Authorized Representative is also authorized to sign any subsequent amendment or agreement that may be required by the State of Minnesota to maintain the City’s connection to the systems and tools offered by the State.
3. That the Attorney, Christopher Nelson, or his successor, is designated the Authorized Representative for the Prosecuting Attorney. The Authorized Representative is also authorized to sign any subsequent amendment or agreement that may be required by the State of Minnesota to maintain the City’s connection to the systems and tools offered by the State.
4. That Tim Sanders, the Mayor for the City of Blaine, Michelle A. Wolfe, the City Manager, and Cathy Sorensen, the City Clerk, are authorized to sign the State of Minnesota Joint Powers Agreements.
PASSED by the City Council of the City of Blaine this 5th day of April, 2021.
