VACATION OF DRAINAGE AND UTILITY EASEMENTS ON LOT 4, BLOCK 1, APRIL RIDGE 4TH ADDITION, VACATION NO. V20-05

 

Background

A petition, dated July 7, 2020, was submitted to the city by Bryce Willaby on behalf of Hogan Real Estate, requesting the vacation of drainage and utility easements on Lot 4, Block 1, April Ridge 4th Addition.  The vacation is necessary as the location and depth of the existing utility within the existing easement can be maintained within a reduced easement width; therefore, the east portion is to be vacated.  The Engineering Department has reviewed this request and concurs with the vacation.

Recommendation

By motion, adopt the Resolution.

 

Body

WHEREAS, the City Council has received a petition dated the 7th day of July, 2020, requesting vacation of drainage and utility easements in April Ridge 4th Addition; and

 

                     WHEREAS, the required public hearing notices were published and mailed, and the public hearing was held on the 9th day of September, 2020, at which time all persons desiring to be heard were given an opportunity to be heard.

 

                     NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine as follows:

 

1.                     The vacation of easements is hereby approved as described:

 

Area 1:

That part of the 45.00 foot wide drainage and utility easement within Lot 4, Block 1, APRIL RIDGE 4TH ADDITION, according to the recorded plat thereof, Anoka County, Minnesota, described as follows:

Commencing at the northeast corner of 100th Avenue NE as depicted on said APRIL RIDGE 4TH ADDITION; Thence northerly along the east line of said Lot 4 for 77.95 feet, more or less, to the south line of the North 85.00 feet of said Lot 4; Thence deflect to the right 90 degrees 00 minutes 00 seconds 21.00 feet to the point of beginning; Thence deflect to the right 90 degrees 00 minutes 00 seconds 130.00 feet; deflect to the left 90 degrees 00 minutes 00 seconds 24.00 feet to the easterly line of the above described 45.00 foot wide drainage and utility easement; deflect to the left 90 degrees 00 minutes 00 seconds, along the last described easterly line, 130.00 feet; Thence deflect to the left 90 degrees 00 minutes 00 seconds 24.00 feet to the point of beginning.

 

Area 2:

The South 5.00 feet of the North 90.00 feet of the West 50.00 feet of the East 95.00 feet of Lot 4, Block 1, APRIL RIDGE 4TH ADDITION, according to the recorded plat thereof, Anoka County, Minnesota.
