DISCUSS LEVER STREET (125TH AVENUE AND 132ND AVENUE) IMPROVEMENT PROJECT 17-07 ASSESSMENT AND PROJECT UPDATE

 

Background

 

The following is the timeline of the Lever Street project and all of the actions that have taken place.

 

March 6, 2017, the city received a petition for public improvements to be extended into the Lever Street area north of 125th Avenue.  The petition contained signatures from property owners representing 63% of the Lever Street frontage.

 

March 16, 2017, Council Declared the Adequacy of the Petition and ordered the Preparation of Feasibility Report.

 

June 1, 2017, Council received the Feasibility report and ordered a Public Hearing.

 

June 28, 2017, City staff held a neighborhood informational meeting at city hall to answer any questions about the proposed report and the scope of the project.

 

July 13, 2017, City Council held the Public Hearing and ordered the improvements.  Council also reduced the amount of the proposed street assessments to the non-petitioning properties by 50% and directed staff to identify a funding source and bring back to council.

 

August 17, 2017, Staff proposed several options to provide assessment assistance.  Council direct staff to transfer $282,161 in Unrestricted General Fund Reserves to the project to reduce the non-petitioning properties street assessment.

 

March 1, 2018, Council approved the Plans and Specifications for the project and ordered the Advertisement for Bids.

 

March 18, 2018, City receives report on Appraisal Benefit for the non-petitioning parcels.

 

April 5, 2018, a council item was prepared to recommend award of the project to the apparent low bidder.  Item was pulled, as there was an issue with the low bidder.

 

April 19, 2018, Council awarded the contract to the second low bidder.

 

March 16, 2020, Council received the assessment role and ordered the public hearing.

 

The public hearing is currently scheduled for May 4, 2020. 

 

Summary of the assessments for the 6 non-petitioning parcels.  The utility portion of the assessments for sanitary sewer and water main are all deferred until the individual parcels develop.  The street portion of the assessments have all been reduced by 50% based on the council action authorizing the use of $282,161 from the Unrestricted General Fund Reserves.  The benefit analysis recommended that two of these parcels be further reduced.  Staff is recommending that the street assessment be reduced further for these two parcels.  The reduction creates a $9,000 gap in funding. Staff is recommending that PMP funds be used to cover this gap.

 

Several of the petitioning parcels have since developed and have subdivided into multiple lots.  The original National Land Investor property subdivided into 56 lots of the Woodridge 1st and 2nd addition and developed by Lennar.  The assessment for this parcel is the full assessment for the street and utilities and was split and placed on the 56 lots. 

 

The original Cox and Birney properties, developed by the Excelsior Group, into the Mill Ponds plat.  This plat has 36 lots and 2 outlots that are now shown on the assessment roll.  The assessment for these two original parcels is the full assessment for the street and utilities and was split and placed on the 36 lots and 2 outlot. 

 

The two original Herbst properties were developed by the Excelsior Group into the Oakwood Ponds 1st and 2nd addition plats.  These plats have 18 and 10 lots respectively and are now shown on the assessment roll.  The assessment for these two original parcels is the full assessment of the street and utilities and was split and placed on the 28 lots. 

 

The three remaining parcels from the original petition ISD #11, Almberg, and Bruggeman parcels are on the assessment roll with the full assessment for street and utilities.

 

 

 

 

 

 

 

Recommendation

Review the project and assessments on the Lever Street project in preparation for the public hearing.
