Title
EXTENDING THE PERIOD OF A COUNCIL-DECLARED LOCAL EMERGENCY FOR A UTILITY BREAK AT 35W SERVICE DRIVE AND 93RD AVENUE
Background
Staff is requesting the Declaration of a State of Local Emergency be extended for the January 25 utility break on 35W Service Drive at 93rd Avenue NE.
Per Article II, Sec. 30-35 of the Blaine Code of Ordinances, any declaration of an emergency in excess of three days must receive the consent of the city council.
The City Council declared this to constitute a local emergency at their meeting of February 2, 2020 and granted an extension on March 2. At their meeting of March 3, 2020, the City Council granted an extension of the local emergency declaration to April 7, 2020. Work continues and it is necessary to extend the declaration for several more weeks.
Recommendation
By motion, approve the resolution extending the period of a Council-declared local emergency.
Body
This resolution is enacted under authority of Minnesota Statutes Sections 12.29 and 12.37.
WHEREAS, the Mayor of Blaine (the “Mayor”) has found that the following situation (the “Situation”) exists:
Water main and sewer main breaks on 35W Service Drive at 93rd Avenue NE
WHEREAS, the Mayor has declared that the situation is a local emergency; and
WHEREAS, the City Council of Blaine agrees with the Mayor’s findings and further finds that the Situation will last for more than three days; and
WHEREAS, on February 2, 2020 the City Council declared the situation to be a local emergency continuing until March 3, 2020; and
WHEREAS, on March 2, 2020 City Council extended the declaration until April 7, 2020; and
WHEREAS, the repairs are still underway and the work is expected to last several more weeks;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Blaine as follows:
The city council declares that the Situation constitutes a local emergency and extends the Declaration of a State of Local Emergency to May 5, 2020.
This declaration of a local emergency will invoke the city’s disaster plan. The portions that are necessary for response to and recovery from the emergency must be used.
