CHAPTER 22 - BUSINESSES, ARTICLE V. - PAWNBROKERS

 

Background

The current pawnbrokers ordinance states “the most current version of the Minneapolis automated pawn system interchange file system” be used for transaction reporting.  As of January 1, 2020, Minneapolis will no longer be using APS so a replacement system will be needed.  Staff has identified Leads Online as the likely system to use but any change would require an ordinance amendment as outlined below.

 

First reading was held on November 18 with no changes proposed.

 

Recommendation

Hold second reading and adopt the ordinance amendment as proposed.

THE CITY OF BLAINE DOES ORDAIN:   (Added portions are underscored and deleted portions are shown in brackets with overstrike.)

 

Sec. 22-206. - Records required.

 (b) Each licensee shall keep a record of each transaction made in the course of business. Such records shall be in a form prescribed by the police chief, or his/her designee, at his or her discretion, and shall, in all instances, be legibly made in ink and be in the English language; or in the case of computerized records, data shall be accurately entered. The pawnbroker shall maintain such records on the premises for all pawn transactions for at least three years from the date of each transaction. These records shall be a correct copy of the entries made of the pawn transactions. A pawnbroker shall upon request provide to the appropriate law enforcement agency a complete and accurate record of pawn transactions. If the pawnbroker provides the records in a computerized format, they must be provided in the interchange file specification format. For purposes of this paragraph, "interchange file specification format" means [the most current version of the Minneapolis automated pawn system interchange file specification format] transactional data must be uploaded to the current system used by the Blaine Police Department at the time of upload.
