AMENDING CHAPTER 22 - BUSINESSES, ARTICLE VI. - PEDDLERS, SOLICITORS, AND TRANSIENT MERCHANTS, OF THE CODE OF ORDINANCES OF THE CITY OF BLAINE

 

Background

Staff is recommending repealing the current Peddlers, Solicitors, and Transient Merchants ordinance in its entirety and adopting the attached ordinance based on the League of Minnesota Cities model.  First reading was held on October 21 with no changes.  The proposed ordinance includes a purpose and clarified definitions as well as a clearer outline of the application process and reasons for denial.  Language was also amended regarding hours and days for soliciting in accordance of the First Amendment.  No changes were made to the current requirement of a City-issued photo identification badge for licensed peddlers and solicitors as this has proven to be an important tool for residents to know the individual has completed the application process and passed a successful background investigation.

 

Staff will post information in the City newsletter, website and social media channels on activities allowed without a license, particularly political canvassing.

 

Recommendation

Hold second reading and adopt the proposed ordinance.
