Title

CONSIDER APPROVAL OF A THERAPEUTIC MASSAGE ENTERPRISE LICENSE FOR THE LOUNGE DAY SPA, 11820 ULYSSES STREET NE (SUITE # TO BE ASSIGNED), BLAINE, MN 55449

 

Background

Melanie Newville, owner and applicant, has submitted an application for a Therapeutic Massage Enterprise license for The Lounge Day Spa, located at 11820 Ulysses Street NE (suite # to be assigned), Blaine.  The applicant has submitted a license application, the license and background fee, and all other required documentation. The certificate of liability insurance and worker’s compensation will be submitted closer to opening, which is anticipated to be in January 2020.  The Blaine Police Department is in the process of conducting a background investigation on this individual. 

 

The new building, North Central Plaza, is a 14,013-square foot office building with five tenant spaces, the largest of which will be the spa at approximately 6,300 square feet.  A 400-square foot patio was approved for the spa in the conditional use permit but the applicant has indicated the patio will be for staff use only and not customer space and a condition was included in the resolution stating the space cannot be used for outdoor dining.

 

On August 21, 2019 Melanie Newville and Clint Myhre, provided the city with a purchase agreement for Clint’s Therapeutic Massage located at 9548 Monroe Street NE.  Mr. Myhre intends to transfer his enterprise to Ms. Newville and cease operation, contingent upon Council approval; his current license expires December 31, 2019.  While City code states that the number of enterprise licenses shall not exceed 10 it also provides for the transfer of a license in good standing as outlined below:

 

Sec. 22-431. - License restrictions.

(c) Transfer of license prohibited. The license issued is for the person or the premises named on the approved license application. No transfer of a license shall be permitted from place to place or from person to person without complying with the requirements of an original application. Transfer of ownership of a current licensed therapeutic massage enterprise in good standing may be applied for but does not ensure approval of a new therapeutic massage enterprise. The council is not required to issue the full number of therapeutic massage enterprise licenses that it has available.

If the license transfer is approved the total number of enterprises will be 19.  While the goal is to reach a maximum number of 10 licenses through attrition staff feels the addition of this enterprise will be a good to the city, providing for approximately 24 jobs in total and allowing a current enterprise in good standing to sell his business.

By motion, approve a Therapeutic Massage Enterprise License for The Lounge Day Spa, located at 11820 Ulysses Street NE (suite # to be assigned), Blaine.
