RECEIVE PETITION AND ORDER PUBLIC HEARING FOR VACATION OF DRAINAGE AND UTILITY EASEMENT FOR LOT 7, BLOCK 4, COOPERS MEADOWS, VACATION NO. V19-03

 

Background

The City received a petition on June 7, 2019 from Dustin Fiecke, property owner at 1030 111th Avenue NE, requesting the vacation of drainage and utility easements for the purposes of locating a shed in rear yard.  When the lots were originally platted in 2000, the rear yard area was delineated as a wetland.  Over time, the wetland characteristics have degraded.  As such, the Coon Creek Watershed District and Anoka Conservation District have determined the wetlands to be gone.  In order to build in the area, the easement must be vacated.  The applicant represents 100% of the affected property abutting this easement.

Recommendation

By motion, adopt the Resolution.

 

Body

WHEREAS, the City Council has received a petition dated the 7th day of June 2019, requesting vacation of drainage and utility easement of Lot 7, Block 4, Coopers Meadows; and

 

                     WHEREAS, the Engineering Department has reviewed the petition and recommends that the City Council hold a Public Hearing on the requested vacation.

 

                     NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine as follows:

 

1.                     The Council will consider the petitioned vacation of easements for the property owner.

 

2.                     A Public Hearing shall be held on the proposed vacation at 7:30 PM on the 5th day of August, 2019 and the City Clerk shall give mailed and published notice of such hearing and vacation as required by law.
