Planning Commission

The Planning Commission voted unanimously to approve the conditional use permit amendment. There were no comments at the public hearing.

 

Background

This application is for the former Gander Mountain site which was developed in 2006, with the approval of the conditional use permit Resolution 05-245, and vacated at the end 2017. Given that the owner wishes to subdivide the building into three (3) tenant spaces at this time, there will be minimal necessary site work. This will be further detailed throughout the report. There is a tenant interested in occupying one of the new tenant spaces, and this item is also on the agenda.

 

The parking plan shows 336 existing parking stalls. Parking will be monitored by staff with each permit that is issued for the site. The tenant interested in occupying a portion of the building is an amusement and recreational use. Previously, when Gander Mountain occupied the space, 336 stalls met the minimum parking requirement. However, the proposed use of amusement and recreation will require a slightly different parking calculation due the fact that the establishment will also serve food and refreshments. The proposed use will require 84 parking stalls. Therefore, the existing outdoor storage area, on the north side of the building, will be converted to additional parking. This will add an additional 42 parking stalls to the site for a total of 378 parking stalls. This work will require site plan approval.

 

The landscape plan indicates that the existing landscaping is meeting the current code requirements; therefore, no landscaping upgrades are required at this time.

 

The PBD (Planned Business District) zoning district requires a conditional use permit for all uses, and all uses meet the requirements of the PBD (Planned Business District). The main purpose of this Conditional Use Permit amendment will be to allow the site to transition from a single tenant retail building to a multi-tenant retail building. The applicant is proposing two (2) or three (3) tenants for the building. One tenant is currently interested in occupying 22,500 square feet of the building for a Family Entertainment Center. The remaining 43,500 square feet of the 66,000 square foot building will be used for retail. We are not aware of any other potential tenants at this time.

 

There is an existing, non-conforming, billboard on site. In the original conditional use permit issued for Gander Mountain in 2005, a condition of approval was that the existing billboard was to be removed no later than August 31, 2016 when the lease agreement for the billboard was set to expire. The property owner has been in contact with the responsible party and is currently working on getting the billboard removed at this time.

 

Recommendation

By motion, approve the Resolution.

Body

                     WHEREAS, an application has been filed by Duck Hill LLC (Gonzalo Medina) as Conditional Use Permit Case File No. 18-0028; and

 

WHEREAS, said case involves the land described as follows:

LOT 1, BLOCK 1, BALTIMORE ADDITION, ANOKA COUNTY, MINNESOTA.

 

                     WHEREAS, a public hearing has been held by the Blaine Planning Commission on May 8, 2018; and

 

                     WHEREAS, the Blaine Planning Commission recommends said Conditional Use Permit be approved; and

 

                     WHEREAS, the Blaine City Council has reviewed said case on June 7, 2018.

 

                     NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that a Conditional Use Permit amendment is hereby approved per Section 31.33 (11) and (15) of the Zoning Ordinance to allow for a 66,000 square foot multi-tenant building composed of general retail, professional office, and restaurants without outdoor dining to be located at 10650 Baltimore Street NE, based on the following conditions:

 

1.                     Each future tenant will be required to obtain a Certificate of Occupancy.

2.                     Review and permitting, meeting all Building and Fire Code requirements, will be required prior to any interior or exterior changes to the building.

3.                     Site Plan Approval required prior to any site work or building permits for new construction.

4.                     The existing, non-conforming, billboard must be removed prior to site plan approval.

5.                     At the time of occupancy, each tenant will be required to complete the exterior facade upgrades, as generally shown on the attached building elevations.

6.                     All signage on site, permanent or temporary, must adhere to the signage requirements of the Zoning Ordinance. All signage requires a separate permit.

7.                     No outside display or storage of products is allowed at any time on site with the exception of Outside Display as regulated by Section 30.081 of the Zoning Ordinance.

8.                     Adequate onsite parking will be monitored by staff with each building permit and Certificate of Occupancy that is issued for the site.

9.                     The approval of this resolution replaces the original CUP Resolution No. 05-245.

 

PASSED by the City Council of the City of Blaine this 7th day of June, 2018.
