Planning Commission

The Planning Commission voted unanimously to approve the conditional use permit.  There were no comments at the public hearing.

 

Background

The PBD (Planned Business District) requires a conditional use permit for all uses including for amusement and recreational uses. This conditional use permit request is for a 22,500 square foot indoor amusement and recreation facility. At this time, the facility will be referred to as Blaine Family Entertainment Center.

 

The applicants have described the facility in their attached narrative. Blaine Family Entertainment Center will consist of a variety of activities including bumper cars, laser tag, a climbing wall, mini bowling, an XD theater, a ropes course, and several other games.

 

One of the most obvious concerns that prompts the conditional use permit review process is that of parking.  The City does not specifically have a parking calculation for this type of amusement/recreation use. Blaine and other similar cities, have a section in the zoning ordinance that allows staff and the Council to determine the appropriate number of parking spaces for a gym or recreation facility (Section 33.14 (i)(20)).  Other cities have a parking calculation for a community center, which is the most similar use that could be found in other cities zoning ordinances.  The parking calculation for a community center is one space for every 300 square feet of floor area.  Blaine has used this number for parking calculations for our larger gyms and for other similar facilities throughout the city.

 

This facility then, based on the proposed uses, will require 84 parking stalls. The parking plan shows an existing 336 parking stalls on site and the applicants will be adding 42 stalls in place of the previous outdoor sales area. This will provide a total of 378 parking stalls on-site. It is important to note that staff will continue to monitor parking on-site as future tenants express interest in occupying the remaining 43,500 square feet of the building. 

 

Previously, Gander Mountain occupied the building. The existing outdoor sales area will need to be removed. The applicants have indicated that the area will become additional parking. This work will require site plan approval, which is an administrative process. Please note that there is a corresponding item on this agenda for the conditional use permit for the overall site with conditions that site plan approval be obtained. Therefore, the property owner will need to ensure that site plan approval is obtained prior to the site changes.

 

The facility will have approximately 45-50 employees. The planned hours of operation will be Monday through Thursday 11 a.m. to 9 p.m., Friday 10 a.m. to 11 p.m., Saturday 9 a.m. to 11 p.m., and Sunday 10 a.m. to 8 p.m. The applicants have indicated that the above hours are subject to change based on use of the facility. It is listed, as a condition of approval, that the hours of operation may need to be limited in order to manage the parking demand, should parking on-site ever become an issue.

 

The applicants have also indicated that there will be a casual food restaurant, where they intend to serve beer and wine to adult patrons. Restaurant area requires a higher parking calculation, and this has already been factored into the total number of required parking stalls (84). The applicants will need to work with the City Clerk’s office to obtain the proper liquor licenses.    

 

Recommendation

By motion, approve the Resolution.

Body

                     WHEREAS, an application has been filed by Duck Hill LLC (Jim and Marilyn Webber) as Conditional Use Permit Case File No. 18-0016; and

 

WHEREAS, said case involves the land described as follows:

LOT 1, BLOCK 1, BALTIMORE ADDITION, ANOKA COUNTY, MINNESOTA

 

                     WHEREAS, a public hearing has been held by the Blaine Planning Commission on May 8, 2018; and

 

                     WHEREAS, the Blaine Planning Commission recommends said Conditional Use Permit be approved; and

 

                     WHEREAS, the Blaine City Council has reviewed said case on June 7, 2018.

 

                     NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that a Conditional Use Permit is hereby approved per Section 31.33 (15) of the Zoning Ordinance to allow for a 22,500 square foot indoor entertainment and recreation facility to be located at 10650 Baltimore Street NE (the most northern suite), based on the following conditions:

 

1.                     Any expansion of the entertainment center would require a conditional use permit amendment.

2.                     All signage on site, permanent or temporary, must adhere to the signage requirements of the Zoning Ordinance. All signage, permanent or temporary, requires a separate permit.

3.                     Hours of operation may need to be limited in order to manage the parking demand, should parking on-site ever become an issue.

4.                     A liquor license must be obtained for the site prior to the serving, or sale, of any alcohol whatsoever.

5.                     The business is to operate as described in the attached narrative.

6.                     No activity is to be conducted outside of the building.

7.                     No outside storage, of any kind, is allowed onsite.

8.                     The interior and exterior tenant finish work is to be completed with review and permit meeting all Building and Fire Code requirements.

9.                     The exterior tenant finish must be completed as shown on the proposed elevations.

10.                      A Certificate of Occupancy is required prior to occupying the space.

11.                      The property owner to obtain site plan approval, and submit the associated SIPA financial guarantees, prior to occupancy.

12.                      The approval of this conditional use permit request is dependent on the approval of the conditional use permit amendment request for the overall site (Case File 18-0028). This approval does not replace the approval of Case File 18-0028 but is in addition to that approval.
