Planning Commission Action

The Planning Commission voted unanimously to approve the comprehensive land use plan. Comments at the public hearing were mainly questions related to service hook-up and timing of development.

 

Background

As part of the City’s 2040 Comprehensive Plan Update that is being drafted at this time, the City Council has indicated they would support a sewer boundary change that will lead to sewer access for an additional 140 acres in Sewer District 7 (serving the Lexington Avenue area) moving to Sewer District 6 (serving the Harpers Street/Lakes area).  This impacts several property owners as they have been told prior to this change that their properties would be the last to obtain sewer access in the City because the sewer line would come from a different direction.  The existing and new sewer boundary lines are attached for your review which indicates which properties are affected. 

 

Along with the City’s 2040 Comprehensive Plan update the city is also in the process of updating the Sanitary Sewer Comprehensive Plan.   The city council received a petition from five property owners located on 131st Avenue and Legacy Creek Parkway area, currently in Sewer District 7, that wanted the city to consider adding their properties to Sewer District 6.  The City Council requested that one of the tasks of the Sewer Plan update was a review of the sewer capacities available in Sewer District 6, as a significant amount of development has occurred in this sewer district since the last update.  The results of the review determined that an additional 140 acres of Low Density Residential (LDR) housing could be added to District 6 from District 7.

 

The City will be presenting an individual comprehensive plan amendment to the Metropolitan Council to deal with this sewer boundary change ahead of the formal submission of the overall 2040 Comprehensive Plan.  One of the property owners within the new boundary would like to begin construction when and if the amendment is approved by the Met Council, hopefully by mid-summer. 

 

Recommendation

By motion, approve the Resolution.

Body

                     WHEREAS, Minnesota Statutes, Chapter 462.355, Subdivision 2, prescribes the procedure for amending the Comprehensive Plan; and

 

                     WHEREAS, the Planning Commission held a public hearing on April 10, 2018, and recommended approval regarding the Comprehensive Plan amendment request for:

 

The Northwest Quarter of Section 2, Township 31, Range 23, Anoka County Except the West One-Half of the Southwest Quarter of the Northwest Quarter Section 2,

 

Together with the West One-Half of the Northeast Quarter of the Northeast Quarter of  Section 3, Township 31, Range 23, Anoka County.

 

                     WHEREAS, the City Council has reviewed the Comprehensive Plan amendment request and finds the change to be in general conformance to the adopted Comprehensive Plan for land use compatibility; and

 

          WHEREAS, the City Council recognizes that the sewer area amendment requires the review and approval by the Metropolitan Council and that the amendment cannot be implemented until that occurs.

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that the land use plan be amended to change portions of the property, as described above, and based on land use maps contained within Case File No. 18-0024, to change the sanitary sewer boundary line between Sewer District 6 and Sewer District 7 to allow for 140 acres to be removed from District 7 to be served from District 6, based on the following rationale:

1.                     The 2018 Sanitary Sewer Comprehensive Plan update models that sewer capacity is available in District 6 to serve an additional 140 Acres of LDR.

2.                     Moving 140 acres from District 7 to District 6 sanitary sewer area helps create better capacity balance between these two sewer districts.
