Planning Commission

The Planning Commission voted unanimously to approve the Conditional Use Permit.  There was one comment received via email in support of the application.

 

Background

In the FR (Farm Residential) zoning district a conditional use permit is required for accessory building space over 1,200 square feet and up to 3,000 square feet for parcels located inside the MUSA (Metropolitan Urban Service Area). This parcel is located inside the MUSA.

 

The applicants are requesting a conditional use permit to allow for a 2,000 square foot detached garage and a total of 2,950 square feet of accessory garage space. There is currently an attached garage that totals 529 square feet and there is currently a detached shed that totals 421 square feet.

 

The applicants have recently purchased the home and thoroughly researched the conditional use permit requirements before purchasing the property. They are requesting the additional garage space for storage of personal property, vehicles, and other recreational items. They would like to keep the existing shed on the property for personal storage as well. The proposed new garage will be used to store equipment that their daughter uses daily. The proposed location of the new garage is essential for accessing this equipment.

 

The FR (Farm Residential) zoning district requires a conditional use permit for accessory buildings located within the front yard, provided that the building meets a 100-foot front yard setback requirement. The proposed new garage currently shows a 225-foot front yard setback. This well exceeds the minimum 100-foot front yard setback.

 

The FR (Farm Residential) zoning district limits accessory building height to no higher than the principal building height. The proposed garage height is 21.5 feet and the principal building height is 25.5 feet. Therefore, the proposed building currently meets the height requirements.

 

The FR (Farm Residential) zoning district only requires the first 35 feet of driveway, abutting the street, to be hard surfaced. The applicants have indicated that the entire driveway is currently hard surfaced. The applicants have also indicated that they will be constructing an additional driveway to the newly proposed garage. In the FR (Farm Residential) zoning district, all driveway area must meet a minimum 5-foot setback from all property lines. Therefore, any newly constructed driveway(s) must meet this setback requirement.

 

The FR (Farm Residential) zoning district requires that the architectural style and color of accessory buildings be compatible with the principal building. The applicants have provided a photo of the existing home and have indicated that the newly proposed garage will be tan and green to match the principal building.

 

Recommendation

By motion, approve the Resolution.

Body

                     WHEREAS, an application has been filed by Joseph and Amanda Prosek as Conditional Use Permit Case File No. 18-0017; and

 

                     WHEREAS, a public hearing has been held by the Blaine Planning Commission on April 10, 2018; and

 

                     WHEREAS, the Blaine Planning Commission recommends said Conditional Use Permit be approved; and

 

                     WHEREAS, the Blaine City Council has reviewed said case on May 3, 2018.

 

                     NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that a Conditional Use Permit is hereby approved per Section 29.10 of the Zoning Ordinance to allow for a 2,000 square foot detached garage, with a total of 2,950 square feet of accessory garage space on the property, and to allow an accessory building to be located in the front yard at 4851 114th Lane NE based on the following conditions:

 

1.                     A building permit must be obtained prior to the start of any construction. The construction of the building will need to meet the requirements of the Uniform Building Code.

2.                     The proposed building is to be generally located as shown on the proposed sketch and will need to meet the minimum 100-foot front yard setback.

3.                     The total accessory building space on the property is not to exceed 2,950 square feet. The newly proposed building is not to exceed 2,000 square feet.

4.                     The existing and proposed accessory building space must only be used for personal storage. It may not be used for a home occupation.

5.                     The materials and colors used on the proposed building will need to match those used on the principal building.

6.                     The height of the proposed building may not exceed the height of the principal building.

7.                     All driveways must meet the minimum 5-foot setback requirement.
