Planning Commission

The Planning Commission voted unanimously to approve the Conditional Use Permit.  There were two comments received via email that were both in support of the application.

 

Background

The R-1 (Single Family) zoning district requires a conditional use permit for more than two (2) accessory structures. The applicant currently has an attached garage and a detached shed. The applicant is requesting to build a third accessory structure on the property.

 

The existing attached garage is approximately 462 square feet and the existing shed is approximately 70 square feet. The proposed new shed will be 196 square feet. The R-1 (Single Family) zoning district allows up to 1,000 square feet of garage space without a conditional use permit. If the conditional use permit for a third accessory structure is approved the total accessory garage space on the property will be 728 square feet. This is still well under the maximum requirement, in this zoning district, of 1,000 square feet.

 

The applicant has stated, in the attached narrative, that the existing location of the pool in the rear yard, along with setback requirements, makes it difficult to increase the size of the existing shed. The applicant has stated that the existing attached garage currently stores a vehicle and a motorcycle and that the existing shed currently stores the pool pump along with some lawn and garden items. The proposed new shed would be used to store tools and supplies related to woodwork and leatherwork. The applicant has indicated that these tools are currently located in a storage facility; however, the applicant would like to further pursue these hobbies in his retirement.

 

The R-1 (Single Family) zoning ordinance requires that the materials and colors of the accessory structures match those of the primary structure. The applicant has provided pictures of the existing home and existing shed. The proposed elevations for the new shed are consistent with the existing structures.

 

The R-1 (Single Family) zoning district limits the height of accessory buildings to less than the height of the primary building. Both buildings are single story structures.

 

Recommendation

By motion, approve the Resolution.

Body

                     WHEREAS, an application has been filed by David Spalding as Conditional Use Permit Case File No. 18-0014; and

 

                     WHEREAS, a public hearing has been held by the Blaine Planning Commission on April 10, 2018; and

 

                     WHEREAS, the Blaine Planning Commission recommends said Conditional Use Permit be approved; and

 

                     WHEREAS, the Blaine City Council has reviewed said case on May 3, 2018.

 

                     NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that a Conditional Use Permit is hereby approved per Section 29.30 of the Zoning Ordinance to allow for three (3) accessory structures in an R-1 (single Family) zoning district at 12017 Washington Street NE based on the following conditions:

 

1.                     A building permit must be obtained prior to the start of any construction. The construction of the shed will need to meet the requirements of the Uniform Building Code.

2.                     The proposed shed is to be generally located as shown on the proposed sketch and will need to meet the 5-foot side and rear yard setbacks.

3.                     The total number of accessory structures is not to exceed three (3) and the total accessory garage space on the property is not to exceed 728 square feet.

4.                     The existing garage and proposed shed must only be used for personal storage. It may not be used for a home occupation.

5.                     The materials and colors used on the proposed building will need to match those used on the principal building.

6.                     The height of the proposed building may not exceed the height of the principal building.
