VACATION OF DRAINAGE EASEMENTS ON OUTLOT B, NORTH OAKS PONDS EAST, AND UTILITY AND DRAINAGE EASEMENTS ON OUTLOT A, NORTH OAKS PONDS EAST 2ND, VACATION NO. V17-09
Background
This is a City initiated vacation of easements. One of the permit requirements for the City’s open space project is to grant a conservation easement over the area in the project. The conservation easement language however conflicts with existing easements that were platted with the original property in the early 1990’s. This vacation will remove the underlying easements and a new document will dedicate a conservation easement over them. The Engineering Department has reviewed this request and concurs with the vacation. A Public hearing was held February 1, 2018, with no public comment.

By motion, approve the Resolution.
Body
WHEREAS, the City Council has initiated the vacation of drainage easements on Outlot B, North Oaks Ponds East, and vacation of utility and drainage easements over a portion of Outlot A, North Oaks Ponds East 2nd; and
WHEREAS, the required public hearing notices were published and mailed, and the public hearing was held on the 1st day of February 2018, at which time all persons desiring to be heard were given an opportunity to be heard.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine as follows:
1. The vacation of drainage easements at Outlot B, North Oaks Ponds and vacation of utility and drainage easements Outlot A, North Oaks Ponds East is hereby approved as described:
That part of Outlot B, NORTH OAKS PONDS, Anoka County Minnesota and that part of Outlot A, NORTH OAKS PONDS EAST, Anoka County Minnesota lying northerly of a line described as beginning at the northeast corner of Outlot C, said NORTH OAKS PONDS EAST; thence on an assumed bearing of North 89 degrees 42 minutes 35 seconds West, along the north line of said Outlot C, a distance of 131.22 feet to a point distant 857.78 feet east from the northwest corner of said Outlot C; thence North 00 degrees 00 minutes 00 seconds East a distance of 1149.21 feet; thence South 89 degrees 54 minutes 16 seconds West a distance of 1206.54 feet to the westerly line of said Outlot A; thence North 67 degrees 23 minutes 15 seconds West a distance of 1445.76 feet to a point on the west line of said Outlot B distant 1000.20 feet north from the southeast corner of Outlot V, THE LAKES OF RADISSON and said line there terminating, and which lies south of the following described line:
Commencing at the northeast corner of Outlot A, NORTH OAKS PONDS EAST, thence South 00 degrees 24 minutes 37 seconds West (assumed bearing) along the east line of said Outlot A, a distance of 60.00 feet to the point of beginning of the line to be described; thence North 89 degrees 16 minutes 10 seconds West a distance of 4032.11 feet to the east line of Outlot Z, THE LAKES OF RADISSON TWENTIETH ADDITION and said line there terminating.
Excepting there from a 50 foot strip of land, said strip being 25 feet on each side of the following described centerline:
Commencing at the northeast corner of Outlot C, NORTH OAKS PONDS EAST; thence North 00 degrees 17 minutes 25 seconds East (assumed bearing) along the east line of Outlot A, said NORTH OAKS PONDS EAST, a distance of 387.18 feet to the point of beginning of the centerline to be described: thence North 33 degrees 15 minutes 10 seconds West a distance of 365.36 feet; thence North 14 degrees 17 minutes 01 second West a distance of 407.22 feet; thence North 29 degrees 03 minutes 41 seconds East a distance of 560.09 feet; thence North 16 degrees 55 minutes 16 seconds East a distance of 128.75 feet to the east line of said Outlot A and said centerline there terminating.
