Background

Public and written notice has been provided as required by City Charter. A petition dated December 19, 2017, was submitted to the City by Bud Dropps representing Accent Enterprises, Inc. requesting vacation of a portion of Johnson Street NE right-of-way.  The right-of-way is no longer needed and will be combined with adjacent parcels for development.  The applicant represents 50% of the affected property abutting this easement.  The east half of this right-of-way was vacated in 2007.  The Engineering Department has reviewed this request and concurs with the vacation.

Body

WHEREAS, the City Council has received a petition dated the 19th day of December, 2017, requesting vacation of Johnson Street NE right-of-way at Outlot A, Nauman Acres; and

 

WHEREAS, the required public hearing notices were published and mailed, and the public hearing was held on the 1st day of February 2018, at which time all persons desiring to be heard were given an opportunity to be heard.

 

                     NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine as follows:

 

1.                     The vacation of Johnson Street NE right-of-way at Outlot A, Nauman Acres is hereby approved as described:

 

PARCEL A:

That part of the west half of Johnson Street NE as platted and dedicated in the recorded plat of NAUMAN ACRES, Anoka County, Minnesota, which lies northerly of the following described line:

 

Commencing at the southeast corner of Outlot A, NAUMAN ACRES; thence North 00 degrees 13 minutes 25 seconds East (assumed bearing) along the east line of said Outlot A a distance of 93.09 feet to the point of beginning of the line to be described; thence easterly along a non-tangential curve concave to the south, having a radius of 125.00 feet, a central angle of 15 degrees 48 minutes 22 seconds, chord bearing of North 82 degrees 18 minutes 06 seconds East 34.37 feet, a chord distance of 34.37 feet and an arc distance of 34.48 feet; thence South 89 degrees 47 minutes 43 seconds East tangent to said curve 3.45 feet to the east line of said west half and said line there terminating.

 

PARCEL B:

That part of the west half of Johnson Street NE as platted and dedicated in the recorded plat of NAUMAN ACRES, Anoka County, Minnesota, which lies southerly of the following described line:

 

Commencing at the southeast corner of Outlot A, NAUMAN ACRES; thence North 00 degrees 13 minutes 25 seconds East (assumed bearing) along the east line of said Outlot A a distance of 39.63 feet to the point of beginning of the line to be described; thence easterly along a non-tangential curve concave to the south, having a radius of 75.00 feet, a central angle of 27 degrees 00 minutes 51 seconds, a chord bearing of North 76 degrees 41 minutes 52 seconds East, a chord distance of 35.03 feet and an arc distance of 35.36 feet; thence South 89 degrees 47 minutes 43 seconds East tangent to said curve 3.44 feet to the east line of said west half and said line there terminating.
