Background

Lot 4 was platted in 2007 as part of North Central Commons and was subsequently split with a waiver of platting a few years later (as part of the Goodwill development). The undeveloped portion of Lot 4 that remains is subject to a Development Agreement that was executed and recorded as part of the Plat. The lot now has a buyer that does not have any responsibility for the previous plat development that was covered by that Development Agreement.

 

The City is requested to release Development Agreements on a fairly regular basis but Anoka County Property Records (Torrens Division) has required the City Council adopt a resolution that authorizes the Mayor and Clerk to execute the release. There are no development agreement related issues with this parcel.

Recommendation

By motion, approve the Resolution.

 

Body

 

WHEREAS,  a portion of Lot 4, Block 1 of North Central Commons is subject to a Development Agreement from the previous plat of North Central Commons and,

 

WHEREAS, the property owner has requested to City release said lots from the recorded development agreement (Document No. 493305.001) and;

 

WHEREAS, the City has determined that there are no outstanding development issues related to said lot and therefore no further purpose for the agreement.

 

NOW, THEREFORE, BE IT RESOLVED, that the Blaine City Council authorizes the Mayor and City Clerk to execute all necessary documents releasing said Development Agreement for the following described property:

 

That part of Lot 4, Block 1, North Central Commons, according to the recorded plat thereof, Anoka County, Minnesota, lying Northwesterly of a line drawn from the northeast corner of Lot 5, Block 1, said North Central Commons, to the southwest corner of Lot 3, Block 1, said North Central Commons.

 

Together with the benefits contained in Dedication of Easements, Construction Requirements, Repair and Maintenance, dated October 11, 2007, filed October 12, 2007 as Document Number 493096.004, as amended by Amendment to Dedication of Easements, Construction Requirements, Repair and Maintenance filed December 26, 2007 as Document Number 493783.002.

 

Together with the benefits contained in Storm Water Pond Maintenance Dedication dated October 12, 2007, filed October 12, 2007 as Document Number 493096.005, as amended by Amended Storm Water Pond Maintenance Dedication filed December 26, 2007 as Document Number 493783.001

 

Together with the benefits contained in Access and Utility Easement and Maintenance Agreement dated October 12, 2007, filed October 12, 2007 as Document Number 493096.009.
