Planning Commission

The Planning Commission voted unanimously to approve the waiver of platting. There were no comments at the public hearing.

 

Background

Lots 6 and 7, Block 2, Amen Corner 2nd Addition are currently vacant.  The home builder and applicant, Paulson Construction, has discovered that there are side yard setback issues if a typical home were to be constructed on Lot 6 on the current configuration of that lot.  The rear southwest corner of the home would encroach on the side yard setback if there were to be a home constructed on this lot. 

 

The applicant is requesting that the lot line in the rear southwest corner between Lots 6 and 7 be adjusted so the new home to be built on Lot 6 would meet setback requirements.  The shift would add approximately 160 square feet to Lot 6.  Any new home on Lot 7 would still be able to meet all setback requirements with this proposed shift. 

 

Recommendation

By motion, approve the Resolution.

                     WHEREAS, said case involves the division of a parcel into two separate lots, Anoka County, Minnesota, described as follows:

                     PARCEL A

                     Lot 6, Block 2, AMEN CORNER SECOND ADDITION, Anoka County, Minnesota, and that part of Lot 7, said Block 2, described as follows:

 

Beginning at the most easterly corner of said Lot 7; thence North 50 degrees 04 minutes 11 seconds West (assumed bearing) along the northeasterly line of said Lot 7 a distance of 39.97 feet to an angle point on said northeasterly line; thence South 35 degrees 28 minutes 43 seconds East 31.70 feet; thence North 89 degrees 15 minutes 21 seconds East 12.25 feet to the point of beginning.

                     WHEREAS, the Blaine Planning Commission has reviewed said case on February 9, 2016; and

 

                     WHEREAS, the Blaine Planning Commission has recommended said case be approved; and

 

                     WHEREAS, the City Council of the City of Blaine has reviewed said case on March 3, 2016.

 

                     NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that a Waiver of Platting per Section 18-9(B)(2) of the Subdivision Ordinance is hereby granted to Paulson Construction, allowing to record the above described division with the Anoka County Recorder’s Office, based on the following conditions:

 

1.                     The new homes on each of these lots must meet all setback requirements for Amen Corner 2nd Addition.

2.                     Waiver of platting to be recorded at Anoka County. 

3.                     The Mayor, City Clerk and City Manager are hereby authorized to execute

any and all necessary documents, agreements and releases related to the approval, recording or administration of this Waiver of Platting.

 

PASSED by the City Council of the City of Blaine this 3rd day of March 2016.
