Planning Commission

The Planning Commission voted unanimously to approve the conditional use permit.  There were no comments at the public hearing.

 

Background

The property (1.9 acres) on the southwest corner of Davenport Street NE and 105th Avenue is zoned PBD (Planned Business District).  At this time, Buhl Investors wishes to develop this property to include a 17,031 square foot retail building.  The proposed retail building will be part of the National Market Center Development.

 

A conditional use permit is required for all uses in the PBD district.  Therefore, the applicant is requesting approval of a conditional use permit for the retail building, zero lot line on the south property line for a shared parking and drive access, zero lot line on the south side for the proposed building, and 40 foot freestanding light structures.

 

The site plan for this lot indicates that a 17,031 square foot retail building will be located on the site. The retail space is proposed to be a Petsmart. The site plan indicates 88 parking spaces to serve the retail building, which meets ordinance requirements for the general retail type use proposed, there is not adequate parking for any restaurant type uses. 

 

The first phase of this site development was constructed in 2008 with the completion of the Office Max building to the south.  Office Max constructed a little more than half of the parking area.  The first phase included 96 parking stalls and a temporary drive aisle on the north side of the building. 

 

The site will be accessed from the private drive/access on the south side of the site. The accesses will include two entrances off of the private drive/access.  A zero lot line is required along the south property line to allow a drive aisle/access to this site and the other sites located within the National Market Center Development.  The applicant has provided areas to plant landscaping along the property lines.

 

Park dedication has been paid for this parcel.

 

Building Elevations

The PBD zoning district is exempt from the Highway 65 Overlay District requirements, which means that the building standards in the Overlay district do not directly apply to the proposed retail buildings.  However, the City Council has directed staff to encourage applicants to meet the Overlay district standards as far as building construction is concerned, and to apply the standards through the conditional use permit process.  This is done by placing a condition on the permit that states the building must meet these standards. 

 

The elevations that have been provided meet the Highway 65 Overlay District standards with the use of brick, E.I.F.S., and integrally split face rock, on all four sides of the buildings, with glass being included on the front elevation. Staff believes the applicant has made this an attractive building and the elevations presented are recommended for approval.  A condition has been added that states the building must be constructed consistent with submitted materials made part of this conditional use permit application.  The east side of the building is proposed to have a loading dock that will be screened by an 8 foot high block/brick wall. 

 

Landscape Plan

The landscape plan that has been submitted does meet the Highway 65 Overlay District requirements related to the quantity and size of trees required. 

 

Signage

Any signage that is placed on this site requires a separate permit process and is addressed as such in the conditions. 

 

Recommendation

By motion, approve the Resolution.

Body

                     WHEREAS, an application has been filed by Peter Deanovic - Buhl Investors as Conditional Use Permit Case File No. 15-0074; and

 

                     WHEREAS, a public hearing has been held by the Blaine Planning Commission on January 12, 2016; and

 

                     WHEREAS, the Blaine Planning Commission recommends said Conditional Use Permit be approved; and

 

                     WHEREAS, the Blaine City Council has reviewed said case on February 4, 2016.

 

                     NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that a Conditional Use Permit is hereby approved per Section 31.33 (11)(12) of the Zoning Ordinance to allow for construction of a 17,031 square foot retail building, a zero lot line on the south lot line for shared parking and driveway access, a zero lot line on the south side for the proposed building, and 40 foot freestanding light structures in the National Market Center Development at 105th Avenue/Davenport Street NE, based on the following conditions:

 

1.                     Site and buildings to be constructed consistent with submitted materials made part of this Conditional Use Permit application.  However, the site plan will be subject to further site plan review related to landscaping and all site improvements.  The landscape plan to meet the requirements set forth in the Zoning Ordinance including the Overlay District related to quantity and size of trees.

2.                     Site plan and grading approval required prior to site work and building permits.

3.                     Temporary signage regulated under Zoning Ordinance Section 34.13.

4.                     Permanent signage requires a separate permit approval process.

5.                     No exterior unscreened overnight storage of shopping carts, pallets or delivered products.

6.                     No overnight storage of semi trailers or delivery vehicles unless adjacent to loading dock areas.

7.                     All lighting on site must meet requirements established by Section 33.02 of the Zoning Ordinance.  Freestanding light structures limited in height to not more than 40 feet.

8.                     No light or combination of lights that cast light upon a public street shall exceed one-foot candle meter reading as measured at the edge of the roadway. 

9.                     All lights on site must be downlit and shielded to prevent glare or spill onto adjacent roads and properties. 

10.                     Developer shall maintain all sidewalks and landscaping within the public right-of-way.

11.                     The building must be designed and maintained in accordance with the MN Uniform Fire Code.

12.                     The exterior building materials to match those on the submitted plans.

13.                     All site improvements to be included in site improvement performance agreement and covered by an acceptable financial guarantee.

14.                     All necessary cross-access and maintenance agreements be executed and maintained to support the shared access and drives.

15.                     No outside display or storage of products is allowed at any time on site.

16.                     A permit from the Coon Creek Watershed District is required prior to the City’s approval of plans.
