PUBLICATION OF THE TITLE AND SUMMARY OF ORDINANCE 15-2312, AMENDING ARTICLE IX. LICENSING AND REGULATION OF THERAPEUTIC MASSAGE, CODE OF ORDINANCES OF THE CITY OF BLAINE
 
Background
Ordinance 15-2312, Amending Article IX, Licensing and Regulation of Therapeutic Massage, was adopted on June 18, 2015.  Minnesota Statute 412.191, Subd. 4, provides for publication of the title and summary of an ordinance in the case it is lengthy, if the City Council determines that publication of the title and a summary would clearly inform the public of the intent and effect of the ordinance.  As Ordinance 15-2312 is very lengthy staff is recommending adoption of the proposed summary resolution.  The entire ordinance is available for inspection during regular office hours at City Hall and can be forwarded upon request.
 
Recommendation
Adopt the resolution providing for a summary publication of Ordinance 15-2312.  
Body
 
      WHEREAS, City Code states if the City Council of the City of Blaine determines, pursuant to Minn. Stat. § 412.191, subd. 4, that publication of the title and a summary of an ordinance would clearly inform the public of the intent and effect of the ordinance, the Council may, by a four-fifths vote of its membership, direct that only the title of the ordinance and a summary be published with notice that a printed copy of the entire ordinance is available for inspection by any person during regular office hours in the office of the City Clerk. The publication of the title and summary shall be deemed to fulfill all legal publication requirements as completely as if the entire ordinance had been published; and
 
      WHEREAS, the City Council of the City of Blaine has reviewed the text of the Ordinance Summary incorporated herein for Ordinance 15-2312 relating to Article IX. - Licensing and Regulation of Therapeutic Massage, Code of Ordinances of the City of Blaine; and
 
      WHEREAS, the City Council of the City of Blaine determined that the Ordinance Summary clearly informs the public of the intent and effect of Ordinance 15-2312.
 
THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine herby directs that the title and Ordinance Summary of amendments shall be published in the official City newspaper and herby gives notice that printed copies of the complete Ordinance are available for inspection by any person during regular office hours at the Office of the Blaine City Clerk, and that a copy of the entire text shall be posted in the official posting place in the City, and further directs that a copy of this Resolution, as enacted will be published.
 
·      Section 22-422. Findings of Council and 22-424. License Required; Number of Licenses - amended limiting the number of licenses allowed to one enterprise license per every 2,500 in population as determined by annual Metropolitan Council estimate or census
·      Section 22-423. Definitions - amended to expand Accredited Institutions to include those holding accredited status with the Minnesota Officer of Higher Education and clarification on Issuing Authority
·      Section 22-425 Exceptions. - include professional practices licensed or registered by this state and regulated by a governmental body with a board where concerns and complaints could be directed as an allowed exception
·      Section 22-426. License Application - clarification on location addresses to include suite numbers
·      Section 22-427. - License fees - removing 2012 license fee prorate language that is no longer relevant
·      Sec. 22-430. - Locations ineligible for therapeutic massage enterprise license - clarification regarding compliance with State Building Code, Fire Code, and Code of Ordinances; expanding hours of operation to begin at 7:00 a.m. and to have location(s) within Northtown Mall coincide with mall hours; clarification regarding annual inspections and hearings in the event of a revocation and/or suspension
·      Sec. 22-433. - Term, renewal of license. - amending any necessary hearing be held before a hearing officer instead of City Council
·      Sec. 22-434. - Sanctions for license violations. - amending any necessary hearing be held before a hearing officer instead of City Council and restricting ability to reapply after revocation
