The Planning Commission voted unanimously to approve the conditional use permit. There were no comments at the public hearing.
 
Background
The owner of Color Mystique Auto Body and Detailing is requesting a conditional use permit in order to have indoor auto sales at his location at 9999 Goodhue Street NE.  The applicant operates from approximately 5200 square feet in a 59,000 square foot multi-tenant industrial building. He has the opportunity to purchase vehicles from dealers, and on occasion private owners, that bring cars in for repairs at the business.  When the repairs on these cars are more than the owner would like to spend, Color Mystique will buy the vehicles and resell them when the repairs have been made.  This requires that the applicant receive a dealer's license from the State of Minnesota.  
 
The applicant understands that there should be no cars stored outside or be placed for sale outside on the premises at any time.  Since all cars would be parked inside, there is no need for any additional parking or screening on this site.  
 
Recommendation
By motion, approve the Resolution.

Body
      WHEREAS, an application has been filed by Color Mystique as Conditional Use Permit Case File No. 15-0002; and
 
      WHEREAS, a public hearing has been held by the Blaine Planning Commission on January 13, 2015; and
 
      WHEREAS, the Blaine Planning Commission recommends said Conditional Use Permit be approved; and
 
      WHEREAS, the Blaine City Council has reviewed said case on February 5, 2015.
 
      NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that a Conditional Use Permit is hereby approved per Section 31.14(y) of the Zoning Ordinance to allow for indoor auto sales in an I-2 (Heavy Industrial) zoning district at 9999 Goodhue Street NE based on the following conditions:
 
1.      There shall be no outdoor storage, display or sales of vehicles at this location.  
2.      The applicant must meet all requirements of the Building and Fire Codes prior to obtaining the license with the State of Minnesota.  
3.      Any expansion of the use (indoor auto sales) would require a CUP amendment.
