Planning Commission

The Planning Commission voted unanimously to approve the code amendment. There were no comments at the public hearing.

Background

Indoor sales of passenger vehicles is allowed in the I-1 and I-1A (Light Industrial) zoning districts as a Conditional Use Permit. There is a number of auto body or major auto repair uses in other zones (B-2 and I-2) that have the need to hold a dealers license so that they from time to time can transfer title and sell vehicles that they repair or own as part of their business. The State of Minnesota requires a local zoning sign-off on each dealer license and in the B-2 and I-2 zones the City is unable to execute that sign-off.

The proposed amendments to the B-2 and I-2 would allow indoor sales of passenger vehicles with the issuance of a Conditional Use Permit. The uses in those zoning districts would then be treated the same as the current allowance in the I-1 zoning district. Through the CUP the City is allowed to limit the number of cars or otherwise create standards necessary and appropriate for each situation.

By motion, approve the Ordinance.
