The Planning Commission voted unanimously to approve the conditional use permit. There were no comments at the public hearing.
 
Background
The applicant, Jam Hops Gymnastic Factory, Inc., wishes to occupy approximately 7,000 square feet of tenant space in a heavy industrial multi-tenant building at the above location.  The Zoning Ordinance allows this use in this zoning district with the issuance of a conditional use permit.  
 
The applicant currently has a similar facility in Ham Lake and they are looking to rent a new space that would free up space at their Ham Lake facility.  The space would be used for training their competitive gymnasts and cheerleaders.  The gymnasts workout around 3 to 5 hours per practice and parents are not allowed to watch, which means that cars would only be in the parking lot to pick-up and drop off.  There would be approximately 30-50 gymnasts/cheerleaders at a given time in the gym, with start times staggered to alleviate drop off and pick up congestion in the parking lot.  
 
During the school year, the hours of operation will generally be at 3:00 p.m.- 9:00 p.m., Monday through Friday; 8:00 a.m. to 4:00 p.m. on Saturday; and 4:00 to 9:00 p.m. on Sunday.  During the summer the hours of operation will be 8:00 a.m. to 9:00 p.m. Monday through Friday and 4:00 to 9:00 on Sunday.  The gym will not be used for any special events.  
 
Staff's main concern with such uses in industrial areas has always been parking.  The conditional use permit allows the City to review the parking needs of the entire site and it allows for the notification of surrounding businesses.  Based on parking calculations required for this site and the uses within building, the site has more than the required amount of parking spaces for this use.

By motion approve the Resolution.
 
Body
      WHEREAS, an application has been filed by Jam Hops Gymnastics Factory, Inc. as Conditional Use Permit Case File No. 14-0042; and
 
      WHEREAS, a public hearing has been held by the Blaine Planning Commission on August 13, 2014; and
 
      WHEREAS, the Blaine Planning Commission recommends said Conditional Use Permit be approved; and
 
      WHEREAS, the Blaine City Council has reviewed said case on September 4, 2014.
 
      NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that a Conditional Use Permit is hereby approved per Section 31.30 of the Zoning Ordinance to operate a gymnastics and cheerleading facility in an I-2 (Heavy Industrial) zoning district at 1618 99th Lane NE based on the following conditions:
 
1.      The business to operate in terms of hours and class size as described in the attached narrative.
2.      The applicant will need to manage parking demand by staggering start times as necessary so as to not create a parking issue for other building tenants.
3.      No activity/training is to be conducted outside the building.
4.      The interior tenant finish work to be completed with review and permit meeting all Building and Fire Code requirements.
5.      A Certificate of Occupancy is required prior to occupying the space.
6.      All business signage by separate review and permit.
