The Planning Commission voted unanimously to approve the conditional use permit. There were no comments at the public hearing.
 
Background
Pallet Resource Corp. is proposing to locate on the site previously owned and occupied by Durequip on 101st Avenue.  The building and site has been vacated for several years.  Pallet Resources plans to use this location as an additional site to increase production for the company.  This location will manufacture and recycle pallets similar to the current facility operating at 3371 99th Court NE.
 
Pallet Resource Corp. is planning to use the front (south) building for sorting and repairing of pallets.  The back (north) building will be used for prepping and dismantling of pallets.  This is a company that retrieves used wooden pallets from retail/commercial type businesses and recycles them for further use.  Once the pallets have been restored to an acceptable condition, they are returned to manufacturers to be reused for distribution.  This company would like the ability to store the restored wooden pallets and pallet components in the designated outside storage area on the site plan.  The property is zoned I-2 (Heavy Industrial) which allows outside storage with a conditional use permit.  
 
Staff is recommending that three, 2 ½ inch caliper, overstory trees be planted on the front parking setback adjacent to 101st Avenue.
 
The height of the outside storage is limited to 12 feet in height.  This standard has been used in other outside storage areas within the City and is required by the Fire Code.
 
Applicant will need to obtain a Rice Creek Watershed District permit prior to commencing and any site work.
 
Site plan approval is also required prior to issuance of a building permit.  Site plan will need to include extension of water to both buildings for fire and domestic use.  All parking and landscaping requirements would be handled through the site plan approval process.
 
Recommendation
By motion, approve the Resolution.

Body
      WHEREAS, an application has been filed by Pallet Resources Corp. as Conditional Use Permit Case File No. 13-0009; and
 
      WHEREAS, a public hearing has been held by the Blaine Planning Commission on August 13, 2014; and
 
      WHEREAS, the Blaine Planning Commission recommends said Conditional Use Permit be approved; and
 
      WHEREAS, the Blaine City Council has reviewed said case on September 4, 2014.
 
      NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that a Conditional Use Permit is hereby approved per Section 31.14 (e) of the Zoning Ordinance to allow for outdoor storage of pallets in an I-2 (Heavy Industrial) zoning district at 3125 101st Avenue NE based on the following conditions:
 
1.      Fire apparatus access drives shall be located and maintained so that storage of pallets are in sections no larger than 50 feet by 150 feet and are limited to not more than 12 feet in height.  
2.      Site Plan Approval, including the extension of water to both structures for fire and domestic service, is required prior to issuance of a building permit.  All parking and landscaping requirements would be handled through the site plan approval process and made part of a Site Improvement Performance Agreement with financial guaranty.
3.      A copy of the Rice Creek Watershed permit will need to be submitted to the city prior to issuance of Site plan approval or building permit.
4.      All site improvements must be covered by a site improvement performance agreement and an associated financial guarantee.
5.      Outside storage is limited to the delineated area as shown on the attached site plan.  Outside storage is limited to wooden pallets and pallet components, and delivery trucks that are associated with this business.
6.      Any changes to the outside storage area or the materials to be stored outside must be covered by a conditional use permit amendment.  
7.      The landscape plan should include three, 2 ½ caliper, overstory trees in the front yard parking setback adjacent to 101st Avenue.
8.      All Building and Fire Code requirements to be met on site.
