The Planning Commission voted unanimously to approve the preliminary plat and conditional use permit. There were no comments at the public hearing.
 
Background
There is a 3 acre commercial outlot on the northeast corner of Legacy Creek Parkway and 125th Avenue that has remained undeveloped for several years.  At this time Stepping Stones Early Learning Center wishes to locate a facility on this property that is zoned B-2 (Community Commercial).  The use as a school/day care requires a conditional use permit in this zoning district.  A preliminary plat is also being requested at this time that changes the outlot into a platted lot.  
 
One lot is proposed with this plat that changes the existing outlot into a platted lot so a building permit could be issued on this site.  The plat drawings indicate that this plat would be known as Legacy Creek 4th Addition, but there is already a 4th Addition in existence.  The plat name must be changed to Legacy Creek 5th Addition.  
 
Park dedication will be required for this lot at the rate of $8,289 per acre for a total park dedication fee of $24,867.  This fee must be paid prior to release of final plat mylars for recording at Anoka County.
 
The site previously paid the parcel's share for 125th Avenue/Legacy Creek Parkway/North Lakes Boulevard improvements at time of original platting.
 
Recommendation
By motion, approve the Resolution.

Body
      WHEREAS, an application has been filed by Stepping Stones Early Learning Center as subdivision Case File No. 14-0044; and
 
      WHEREAS, said case involves the division of land described as follows:
 
OUTLOT G, LEGACY CREEK ADDITION, ANOKA COUNTY, MINNESOTA.
 
      WHEREAS, the Blaine Planning Commission has reviewed said case file on August 13, 2014; and
 
      WHEREAS, the Blaine Planning Commission has recommended subdivision Case File No. 14-0044 be approved subject to certain stipulations; and
 
      WHEREAS the Blaine City Council has reviewed said case file on September 4, 2014.
 
      NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that preliminary plat approval per Section 74-42 of the subdivision regulations is hereby granted for Legacy Creek 5th Addition permitting preparation of a final plat for approval per Section 74-43 subject to the following conditions:
 
1.      The plat name must be changed to Legacy Creek 5th Addition.
2.      Park dedication will be required for this lot at the rate of $8,289 per acre for a total park dedication fee of $24,867.  This fee must be paid prior to release of final plat mylars for recording at Anoka County
3.      The Mayor, City Clerk and City Manager are hereby authorized to execute any and all necessary documents, agreements and releases related to the approval, recording or administration of Legacy Creek 5th Addition.
