Planning Commission
The Planning Commission voted unanimously to recommend approval of the waiver of platting. There were no comments at the public hearing.
 
Background
The applicant owns the two adjacent parcels, 3106 117th Avenue NE (Parcel A) and 3122 117th Avenue NE (Parcel B).  He would like to construct a new home on Parcel B and has determined through the house design process he needs to have an additional 5 feet of lot width.  He prefers the location and water views that Parcel B offers over Parcel A.  Therefore, he wishes to adjust the common property line between the properties 5 feet further west.  After the proposed adjustment both Parcels will continue to meet the lot standards set for this area with Parcel A being approximately 80-feet wide and Parcel B approximately 85-feet wide.  
The existing easement located on the west property line of Parcel B will need to be vacated.  A new easement will need to be dedicated on the newly created east property line of Parcel A.  The applicant has submitted a petition to vacate the easements.
This is a very simple request for a waiver of platting and the conditions you see listed below are conditions listed for similar approvals that have been granted in the past.
 
Recommendation
By motion, approve the Resolution.

      WHEREAS, an application has been filed by Nathan Raich as waiver of platting Case No. 13-0062 and;
 
      WHEREAS, said case involves the division of a parcel into two separate lots, Anoka County, Minnesota, described as follows:
 
CURRENT DESCRIPTION
LOTS 12 AND 13, BLOCK 2, THE LAKES OF RADISSON EIGHTEENTH ADDITION, ANOKA COUNTY, MINNESOTA.
 
PARCEL A
LOT 12, BLOCK 2, THE LAKES OF RADISSON EIGHTEENTH ADDITION, ANOKA COUNTY, MINNESOTA, EXCEPT THE EASTERLY 5 FEET OTHEROF.
 
PARCEL B
LOT 13, BLOCK 2 AND THE EASTERLY 5 FEET OF LOT 12, BLOCK 2, THE LAKES OF RADISSON EIGHTEENTH ADDITION, ANOKA COUNTY, MINNESOTA.
 
      WHEREAS, the Blaine Planning Commission has reviewed said case on December 10, 2013; and
 
      WHEREAS, the Blaine Planning Commission has recommended said case be approved; and
 
      WHEREAS, the City Council of the City of Blaine has reviewed said waiver of platting case on January 2, 2014.
 
      NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that a waiver of platting per Section 18-9(B)(2) of the subdivision regulations is hereby granted, allowing to record the above described division with the Anoka County Recorder's Office, based on the following conditions:
 
1.      The applicant must record the waiver of platting with Anoka County.
 
2.      A new easement will need to be dedicated on the newly created east property line of Lot 12 (Parcel A) prior to a building permit being issued for Lot 12.
 
3.      Existing easements need to be vacated along the west line of existing Lot 13 (Parcel B).
