Background
The proposed Deacon's Pond 3rd Addition plat is zoned DF (Development Flex) and development standards have previously been approved for this property through the required conditional use permit.  The original conditional use permit for this development was approved concurrent with the preliminary plat in 2005 but has been amended a couple times, most recently in 2012.  
 
The original conditional use permit approved through Resolution 05-286 included a condition that required the developer to include noise abatement standards on each home in the plat.  After a discussion with the developer, it appears that these standards may no longer be needed in this plat.  The plat is not near the airport or within 500 feet of a major roadway, which are the City's general criteria with regard to where noise abatement standards should apply.  Therefore, it is proposed that the noise abatement standards be removed from the conditional use permit.  
 
As a side note, the City has chosen in the past to require the noise abatement standards in most of the DF housing conditional use permits.  After this discussion, staff will evaluate the need for noise standards to be applied on future developments based on the criteria stated above and consistent with the language in the Zoning ordinance for other zoning districts.  
 
Recommendation
By motion, approve the Resolution.

WHEREAS, an application has been filed by TJB Development as conditional use permit amendment Case File No. 13-0034; and
 
WHEREAS, the Blaine City Council has reviewed said case on July 11, 2013.
 
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that a conditional use permit is hereby approved per Section 29.80 of the zoning ordinance to remove noise abatement standards for Deacon's Pond 3rd Addition based on the following conditions:
  1. All conditions of Resolution 12-084 to remain in place with the exception of #3 which is hereby removed from the conditions of the conditional use permit for all additions of this development.
