Background
The applicant is proposing to final plat 13 lots to the east of the existing Deacon's Pond 2nd Addition plat.  This new plat and final phase will be known as Deacon's Pond 3rdnd Addition.  The plat is zoned DF (Development Flex) and development standards have previously been approved for this property through the required conditional use permit.
 
The developer will be required to pay park dedication for this plat at the rate of $2,813 per unit, or $36,569, and this fee must be paid as part of the final plat as outlined in the Development Agreement.  
 
The developer will also be required to pay trunk sanitary sewer charges.  A portion of the underlying property was previously assessed for trunk sanitary sewer.  An additional 2.58 acres of trunk sanitary sewer charges become due with platting.  The 2013 rate for trunk sanitary sewer is $3,425 per acre for a total due of $8,836.
 
A 6-foot concrete sidewalk should be placed along the north side of 118th Lane and the west side of both segments Owatonna Street.
 
This plat will complete all additions of the original Deacon's Pond preliminary plat.  Therefore, street connections via Owatonna Street NE will be made to the north and south of this development.  At this time Owatonna Street has been constructed to the property lines in the plats to the north and south of this development.  
 
Recommendation
By motion, approve the Resolution.

PER CHAPTER 74 OF THE SUBDIVISION ORDINANCE
 
WHEREAS, an application has been filed by TJB Development as subdivision Case No. 13-0034; and
 
WHEREAS, said case involves the division of land in Anoka County, Minnesota, described as follows:
 
OUTLOT A AND B, DEACON'S POND 2nd ADDITION AND OUTLOT C, DEACON'S POND ADDITION, ANOKA COUNTY MINNESOTA.
 
WHEREAS, the Blaine City Council granted preliminary plat approval on December 15, 2005, subject to the stipulations as contained in Blaine City Council Resolution No. 05-285; and
 
WHEREAS, the applicant has submitted a final plat in general conformance with the approved preliminary plat.
 
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that final plat approval for Deacon's Pond 3rd Addition per Section 74-43 of the subdivision regulations is hereby granted subject to the following conditions:
    1. A six-foot concrete sidewalk to be placed along the north side of 118th Lane NE and the west side of both segments of Owatonna Street NE.  
    2. The developer will be required to pay park dedication for this plat at the rate of $2,813 per lot, or $36,569. Park fee to be paid as part of the final plat as outlined by the Development Agreement.  
    3. Developer to install grouped mailboxes with design and locations approved by City and US Postal Service.
    4. A portion of the underlying property was previously assessed for trunk sanitary sewer.  An additional 2.58 acres of trunk sanitary sewer charges become due with platting.  The 2013 rate for trunk sanitary sewer is $3,425 per acre for a total due of $8,836.
    5. A tree plan must be provided to determine how custom grading on each individual lot can be accomplished.
    6. A development plan including custom grading information per lot, house type, existing drainage patterns, street grading, tree preservation, and erosion control information shall be submitted for City approval prior to issuance of the first building permit.  Developer shall coordinate the plans with the development to the north of the plat.
    7. The size of site being graded requires a National Pollutant Discharge Elimination System (NPDES) Phase II permit from Minnesota Pollution Control Agency.
    8. Coon Creek Watershed District permit is required prior to the start of site work.
    9. An as-built survey will be required to verify structure elevations, custom grading requirements, and final grading elevations.
  1. The developer will be responsible for installation of sanitary sewer, water main, storm drainage improvements, streets with concrete curb and gutter, sidewalks, streetlights, mailboxes, traffic control signs, street signs, and all appurtenant items.  Plans and specifications must be approved by the City prior to start of construction.
  2. Street names shall be consistent with Anoka County's street name grid system and shall be 118th Lane NE and Owatonna Street NE.
  3. Drainage and utility easements shall be dedicated on all lot lines, over side yards that contain utilities, and storm water detention basin.  Verify water elevations and safety bench design for the ponds.     
  4. A development agreement is required that outlines the developer's responsibilities during the development process.
  5. With this approval the Mayor, City Clerk and City Manager are authorized on behalf of the City to execute any and all necessary agreements, documents and releases relative to the City's effective administration and regulation of this Plat.
 
PASSED by the City Council of the City of Blaine this 11th day of July 2013.
