Background
The City's zoning does not currently allow accessory family living units in the R-1 (type) zoning districts. While other communities have discussed and many have changed ordinances to be more accommodating to this rising demand Blaine has not. Generally this issue or request in Blaine has come up during new home construction. This home at 11659 St Andrews Circle has been issued a building permit but certain elements that would establish it as a separate living unit have been left out of the construction.
 
The DF zoning for this development would allow the City Council to establish this opportunity on a site by site basis based on the details of each specific application. This CUP amendment would allow the owner to install a full kitchen with stove as part of a lower (basement) level 1,200 square foot living area.
 
The discussion and conditions of CUP approval that would be recommended in this instance as well as future requests include as primary elements:
 
· Access for accessory living unit to be interior (no separate exterior access).
· Living unit to be not more than 30% of finished floor area of entire home.
· Home must provide three-stall garage so as to provide additional stall for accessory unit.
· Accessory living unit must continue to be occupied by family member only (parent, sibling, child) and not rented to a non-family member.
 
Notice was sent to the surrounding neighbors of this proposed CUP Amendment.
 
Recommendation
By motion, approve the Resolution.

      WHEREAS, an application has been filed by TJB Homes as Conditional Use Permit Amendment Case File No. 14-0016; and
 
      WHEREAS, the Blaine City Council has reviewed said case on May 1, 2014.
 
      NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that a conditional use permit is hereby approved per Section 29.80 of the Zoning Ordinance to construct a multi-generational home with an approximately 1,200 square foot accessory family living unit at 11659 St. Andrews Circle NE based on the following conditions:
 
1.      Access for accessory living unit to be interior (no separate exterior front or side access).
2.      Living unit to be not more than 30% of finished floor area of entire home.
3.      Home must provide three-stall garage so as to provide additional stall for accessory unit.
4.      Accessory living unit must continue to be occupied by family member (parent, sibling, child) and not rented to a non-family member.
5.      Kitchen elements, and other construction elements as required by the City, must be removed or modified within 120 days after unit is no longer occupied as an accessory living unit.
