Background
On September 3, 2015 at the City Council Workshop, Police Department Staff gave a presentation regarding some necessary changes to the animal-related Ordinances. Two of the changes were meant to update and clarify outdated Ordinances (Rabies and Animal Control Authority). New and updated changes involved Dangerous Dogs and Potentially Dangerous Dogs. Changes to “Restraint” definitions were also added. Finally, though not part of the Workshop presentation, an update to the Ordinance was made regarding police or other public safety service dogs. A summary of these changes are noted, below, along with specific changes to the Ordinances.
• Sec. 14-1 - Adopting MN Statute Chapter 347.50-347.57 by reference
• Sec. 14-2. - Definitions.
o Amending definition of animal control officer to animal control authority and amending definition of restraint
o Adding definition of dangerous dogs and potentially dangerous dogs as defined in State Statute and provocation
o Deleting definition of dog enclosure and amending to include proper enclosure consistent with State Statute
• Sec. 14-4. - Exemptions.
o Expansion of exemptions to include dogs engaged in police, fire, or rescue work
• Sec. 14-43. - Potentially dangerous and dangerous dog determination and appeal
o Establishing process for determination of a potentially dangerous and dangerous dog and outlining appeal process including deadlines, hearing, findings, and fees.
• Sec. 14-44. - Potentially dangerous and dangerous dog regulation
o Establishing regulation of potentially dangerous and dangerous dog registration
• Sec. 14-45. Notification of death or transfer
o Establishing notification requirements for transferring ownership or residence of a potentially dangerous and/or dangerous dog within or outside the City; notification of death of a potentially dangerous and/or dangerous dog; and notification of potentially dangerous and dangerous dog to new owner
• Sec. 54-74. - Dogs to be kept under restraint
o Establishing regulation of all dogs to be under control and on a leash while on designated Blaine city park land or open space.

Recommendation
Hold the first reading of the proposed Ordinance and schedule the second reading and consideration for adoption at the October 15, 2015 Council meeting.
