AUTHORIZE THE MAYOR AND CITY MANAGER TO ENTER INTO AN AGREEMENT WITH GERALD AND MARJORIE RICHELS REGARDING BERM REPAIR WORK

Background

In order to repair the berm at 2163-119^th Avenue, the City's contractor will need to access property owned by Gerald and Marjorie Richels.  An agreement has been prepared between the City and the Richels.  This agreement will allow the City's contractor to enter the Richels property to do restoration work and releases the City from any further action from the Richels.  A condition included in the agreement will be for the Richels to remove all barb wire fencing on their property.  The property owner at 2163-119^th Avenue has agreed to allow the contractor access to their lot to do this work only if the barb wire fence between their lot and the Richels lot is removed and the integrity of their existing chain link fence is not compromised .

Recommendation

By motion, authorize the Mayor and City Manager to enter into an agreement with Gerald and Marjorie Richels allowing the City's contractor access to perform restoration work on the Richels property.
