Title

GRANTING A CONDITIONAL USE PERMIT PER SECTION 33.05 OF THE ZONING ORDINANCE OF THE CITY OF BLAINE FOR A LAND RECLAMATION PERMIT TO DEPOSIT FILL FOR SOIL CORRECTION AT THE NORTHWEST QUADRANT OF DAVENPORT STREET AND 105TH AVENUE

 

Background

The property owner, National Sports Center, is in the early stages of preparing development plans for 120,000 SF domed sports facility structure on their I-1 thru I-4 fields.  The site will require the removal of approximately 30,000 cubic yards of organic/peat soils.  The applicant has an onsite source of granular material suitable for construction located in the adjacent parcel (pit) on their site.  There is currently 2-5’ organic material in this area that will be removed and the elevation will be filled with granular material back to the original grades.  The proposed hours of operation for the work are 7:00 AM to 9:00 PM, Monday thru Saturday.  Staff is recommending that the hauling route be limited to onsite hauling as the soil source and soil correction are all contained with-in the owners site. 

 

The applicant has designed the fill to avoid existing wetlands.  Erosion control measures will be required during construction, including daily watering to minimize dust.  Staging of the work will be required to minimize the amount of exposed material that is subjected to wind and water erosion.  The applicant will need to stabilize the site with a minimum 4 inches of topsoil, seed, and mulch.  The applicant is in the process of obtaining a permit from the Coon Creek Watershed District.  A cash bond will be required as surety for stabilization of the project.

 

No physical site development is proposed or would be permitted with this application, other than the preliminary grading that is described. Subsequent site development, extension of utilities, building construction, and access improvements or other specific development approvals will require future review by the Planning Commission and City Council when those plans have been developed.  Notice of this CUP application was sent to all adjacent property owners.

 

Discussion concerning the status and schedule for the closure of the pit mining operation, relocation of the NSC maintenance facility and completion of the parking and site improvements will be part of the subsequent review for the domed sports facility.

 

Recommendation

By motion, approve the Resolution granting a conditional use permit.

 

Body

 

                     WHEREAS, an application has been filed by the National Sports Center as Conditional Use Permit Case File No. 18-0052; and

 

                     WHEREAS, the Blaine City Council has reviewed said case on August 2, 2018.

 

                     NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that a conditional use permit is hereby approved per Section 33.05 of the zoning ordinance for a Land Reclamation Permit based on the following conditions:

 

1.                     Grading plan must be approved by the City prior to start of construction.  Plan to include details for controlling wind and water erosion.  Only granular soils shall be imported, and no material shall leave the site.

2.                     No more than one (1) acre of area can be filled without being protected from erosion.  Permanent restoration must be established within 14 days of fill placement in an area and shall include 4” topsoil, seed and mulch.

3.                     Grading activity requires a National Pollutant Discharge Elimination Permit (NPDES) from the Minnesota Pollution Control Agency.  A prerequisite to the NPDES includes the preparation of a Storm Water Pollution Prevention Plan (SWPPP) for the site.

4.                     A Coon Creek Watershed District permit is required prior to any site work.  The applicant is required to follow the conditions of their permit.

5.                     All site work must be completed by September 21, 2018.

6.                     Applicant shall post a $20,000 cash escrow to ensure the successful completion of the work, site stabilization, and to cover City expenses related to inspection of the project.  Remaining funds will be returned to the applicant after the project is complete.
