VACATION NO. V15-06
Background
A petition dated December 4, 2015, was submitted to the City by Scott Adams of Buffalo, Minnesota requesting vacation of drainage and utility easements on Lots 2 and 3, Block 1, University Park Addition. This vacation is being requested in order to facilitate the construction of a new commercial building. The applicant is a single property owner who represents 100% of the affected property abutting this easement.

This easement vacation is being processed under the newly adopted Charter amendment to allow easements to be vacated by resolution rather than ordinance. Please note the public hearing process has not changed, just the adoption process.
Recommendation
By motion, adopt the Resolution.
Body
WHEREAS, the City Council has received a petition dated the 4th day of December, 2015, requesting vacation of easements for drainage and utility purposes granted in the plat of University Park Addition; and
WHEREAS, the Engineering Department has reviewed the petition and recommends that the City Council hold a Public Hearing on the requested vacation.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine as follows:
1. The Council will consider the petitioned vacation of easements for drainage and utility purposes for the property owner.
2. A Public Hearing shall be held on the proposed vacation at 8:00 PM on the 18th day of February, 2016, and the City Clerk shall give mailed and published notice of such hearing and vacation as required by law.
