There were no comments at the public hearing and the Planning Commission recommended approval of the conditional use permit.

 

Background

The applicant is requesting a Conditional Use Permit to allow for 1,189 square feet of garage/accessory space.  The applicant currently has an attached garage of 793 square feet and is proposing to construct a detached garage in the rear yard of the property that is 396 square feet.  The property is located within the R-1(Single Family) zoning district, which requires a conditional use permit for garage/accessory space that is between 1,000 and 1,200 square feet. 

 

The applicant currently has a detached shed/garage in the rear of property that will be removed so a new larger detached structure can be constructed.  The existing detached garage will be removed prior to issuance of a building permit for the new detached garage. 

 

The applicant wishes to store a vehicle in the new garage for the winter months.  The new garage will be accessed through a gate in the fence that surrounds the rear yard of the property.  The gate is located on the west side of the house. 

 

The proposed garage will be constructed to match the existing home. 

 

Recommendation

By motion, approve the Resolution.

                     WHEREAS, an application has been filed by Christopher Russo as Conditional Use Permit Case File No. 17-0035; and

 

                     WHEREAS, a public hearing has been held by the Blaine Planning Commission on August 8, 2017; and

 

                     WHEREAS, the Blaine Planning Commission recommends said Conditional Use Permit be approved; and

 

                     WHEREAS, the Blaine City Council has reviewed said case on September 7, 2017.

 

                     NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that a Conditional Use Permit is hereby approved per Section 29.34(i) of the Zoning Ordinance to allow for the construction of a detached garage that is 396 square feet, for a total of 1,189 square feet of garage/accessory space at 1250 130th Avenue NE, based on the following conditions:

 

1. The structure to match the color of the house.

2. A building permit must be obtained prior to construction of the building.

3. The garage to be used for personal storage only.

4. The garage to be generally located as shown on attached sketch and meeting

all required setbacks. The accessory building must be located in the rear yard.

5.  If the applicant uses the garage on a regular basis to create tracks in the yard, a paved driveway must be installed to the garage.

6. The total garage and accessory space on this property is limited to 1,189 square feet.

7. The existing small shed in the rear of the property must be removed prior to a

building permit being issued for the new structure.

8. The proposed structure cannot be used for a home occupation.
