Background

The plat known as Ball Road Addition, was created to facilitate the development of the new Walmart site on Ball Road and Lexington Avenue. That plat also created two outlots for future development on both sides of the entrance road to the Walmart.  Goodwill is now open on one of the replatted outlots on the northeast side of the entrance road to Walmart.  The Driessen Group, LLC requested and received the approval of a preliminary plat for the remaining outlot on the southwest side of the entrance road to Walmart in December, 2015.  A conditional use permit was also approved that would allow for the construction of two multi-tenant retail buildings on the new lot. 

 

At this time the Driessen Group, LLC is no longer involved with this development but the property owner would like to extend the approval of the preliminary plat and conditional use permit in order to further market the property and confirm tenants for the development.  Should the property owner find a user that wishes to deviate from the requirements of the conditional use permit, that user will need to apply for a conditional use permit amendment to make sure the new use is in conformance with the Zoning Ordinance.  The site is zoned PBD (Planned Business District), where every use requires a conditional use permit.

 

The information below is from the original report for the conditional use permit.

 

Conditional Use Permit

The Driessen Group is proposing to construct two 6,500 square foot retail buildings on Lot 1.  There are no known tenants of the building at this time.  Because the site is zoned PBD (Planned Business District), a conditional use permit is required.  The conditional use permit will allow the multi-tenant use of general retail and restaurants along with the two buildings on one lot. 

 

The site plan indicates that the buildings are suitable for a drive-thru use.  There is also a large patio between the two buildings that could possibly be used for outdoor dining in the future should a restaurant occupy any of the spaces.  A six-foot ornamental fence will be placed on the south side of the buildings.  A four-foot ornamental fence will be placed on the northwest side of the parking lot. 

 

There are 83 parking stalls on site and this meets the Zoning Ordinance’s parking requirement of 1 stall per 200 square feet of floor area. The uses of the multi-tenant buildings will also be monitored to make sure that parking does not become an issue on site, especially if restaurant uses and outdoor dining come into play.  There are two entrances to the site from the private entrance road that leads to Walmart.

 

The City Council has required that all sites in the PBD Zoning District, regardless of their location, meet the building and landscaping standards of the Highway 65 Overlay District. The building will be constructed of EIFS, brick and glass and meets the requirements of the Highway 65 Overlay District.

 

The landscape elements that are required on site (per the Highway 65 Overlay District standards) are as follows:

 

Overstory Trees:                                          22

Conifer Trees:                                           11

Ornamental Trees:                      11

 

The plan that has been presented does not meet these requirements and the plan must provide the correct number of trees prior to site plan approval.  In addition, according to the Highway 65 Overlay District requirements, at least 25% of the trees must be oversized.  Overstory trees should be oversized to 3 inch caliper and conifer trees must be oversized to 8 feet in height.  It is not recommended that ornamental trees be oversized. 

 

It should be noted that there is not to be any outside storage allowed on this site at any time.

 

Recommendation

By motion, approve the Resolution.

                     WHEREAS, an application has been filed by Creative Capital Holdings LP as Conditional Use Permit Case File No. 15-0064; and

 

                     WHEREAS, a public hearing has been held by the Blaine Planning Commission on November 10, 2015; and

 

                     WHEREAS, the Blaine Planning Commission recommends said Conditional Use Permit be approved; and

 

                     WHEREAS, the Blaine City Council has reviewed said case on November 3, 2016.

 

                     NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that a Conditional Use Permit extension is hereby approved for six months per Section 31.30 of the Zoning Ordinance to allow for construction of two multi-tenant retail buildings on one lot in a PBD (Planned Business District) Zoning District, located at Lot 1, Ball Road 3rd Addition, based on the following conditions:

 

1.                     The following landscaping is required on site and the landscape plan meets these requirements:

 

Overstory Trees:                                          22

Conifer Trees:                                           11

Ornamental Trees:                      11

 

The plan that has been presented does not meet these requirements and the plan must provide the correct number of trees prior to site plan approval.  In addition, according to the Highway 65 Overlay District requirements, at least 25% of the trees must be oversized.  Overstory trees should be oversized to 3 inch caliper and conifer trees must be oversized to 8 feet in height.  It is not recommended that ornamental trees be oversized.

2.  The developer to add additional conifer trees on the south side of the site to provide greater screening in this area.

3.  All signage is issued under a separate permit.

4.  All pole mounted lighting is limited to 20-feet in height. The applicant must supply a lighting plan and fixture cut-sheets prior to issuance of building permits.

5.  There is not to be any outside storage allowed on this site at any time.

6.                     Site Plan Approval is required to any work being performed on site.  Plans must be substantially consistent with the package provided for the conditional use permit approval and all recommended conditions. 

7.                     Rice Creek Watershed District approval is required prior to issuance of site plan approval and building permits.

8.                     Tennant finish permits, within the multi tenant buildings, will be evaluated based on available parking, especially for higher parking uses such as restaurants.

9.                     Restaurants with outdoor dining will require a separate CUP amendment for the outside seating area.

10.Wall signage needs to be channelized letter style signs (no cabinets) to reduce glare towards residential area to south.

11. Prior to issuance of Final Plat approval the developer will need to identify changes and additions to the landscape plan to provide better headlight and site screening from Ball Road and neighborhood to the south.
