Title
APPROVE WATER TOWER LEASE WITH NEXTERA WIRELESS, LLC
Background
Nextera Wireless, LLC has leased space on the Aquatore water tower for wireless communication services since 2008. The original agreement expires December 31, 2013. The attached agreement would renew that lease for another four years, to December 31, 2017. Pursuant to terms of the lease, Nextera will pay the City $15,184 for lease of the water tower space in 2014. This amount will increase 4% annually through the term of the agreement. At the end of the original four-year term, the lease will automatically renew for two successive four-year terms unless the City receives notification from Nextera at least 60 days prior to the end of the lease of its intent not to renew the lease. The City may deny renewal of the lease at its sole discretion at any time, as long as the City provides Nextera with notification at least 180 days prior to the termination. The agreement has been reviewed by both the City Attorney and Engineering.
