Background
 
The preliminary plat for the Blaine Town Square plat was approved in 2003, and the Planning Commission, at that time, reviewed a concept plan for the layout of the Town Square development.  This item is a request for a conditional use permit for a small medical building to be located on proposed Lot 2 of the plat.  All uses in the DF (Development Flex) zoning district require the approval of conditional use permits.
 
Site Plan and Conditional Use Permit
 
The City and the applicant have negotiated a site plan that meets the standards envisioned by the City for DF (Development Flex) zoning and for the Town Square Development.  Center for Diagnostic Imaging (CDI) is proposing to construct an 8,777 square foot medical building on proposed Lot 2 of the development.  The medical building will contain approximately six exam rooms, equipment rooms, and several offices.  CDI serves patients in need of medical imaging and other radiology procedures.
 
The building being proposed consists of a stone veneer, stucco, and glass, and the building fits in nicely with the architecture of the other buildings within the Town Square development.  The front of the building will face Radisson Road, while the back of the building will face 108th Lane.  The City Council has directed that the buildings in the Town Square development meet the Highway 65 Overlay District standards and the building does meet these requirements.  A condition has been added below that states the site and buildings must be constructed as presented in this application.  
 
The City Council has directed that all sites in the Town Square development meet the Overlay District requirements for landscaping. The landscape plan that has been provided does meet the Overlay District however some oversizing of trees will be required.  
 
The site plan indicates that CDI will share an access with the site to the south.  This access is located on the southeast side of the site.  The shared access with Anchor Bank will provide access to the CDI dumpster enclosure.  
 
Staff has calculated the parking needs for this site and believes that the parking provided on site is appropriate.
 
The lighting to be used on site should be consistent with the overall lighting package for the entire development.
 
Park Dedication was previously paid with the approval of the final plat.

Body
      WHEREAS, an application has been filed by CDI as conditional use permit Case File No. 12-0034; and
 
      WHEREAS, a public hearing has been held by the Blaine City Council on October 18, 2012; and
      
      WHEREAS, the Blaine City Council has reviewed said case on October 18, 2012.
 
      NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that a conditional use permit is hereby approved per Section 29.80 of the zoning ordinance to allow for construction of a 8,777 square foot medical building and a shared access and drive with the adjacent property in a DF (Development Flex) zoning district based on the following conditions:
 
1.      The developer shall install all site improvements in accordance with City performance standards and zoning code Section 27.09, including the financial guarantee and site improvement agreement.
 
2.      Site, buildings, and landscaping to be constructed consistent with submitted materials made part of this Conditional Use Permit application.  However, the site plan will be subject to further site plan review related to landscaping and all site improvements.
 
3.      Site plan and grading approval required prior to site work and building permits.
 
4.      Temporary signage regulated under Zoning Ordinance Section 34.13.
 
5.      Permanent signage requires a separate permit approval process.
 
6.      All lighting on site must meet requirements established by Section 33.02 of the Zoning Ordinance.  Freestanding light structures limited in height to not more than 20 feet.  The lighting should be coordinated with the Town Square Development, as all lighting will be the same/similar throughout the Town Square Development.
 
7.      The building must be designed and maintained in accordance with the MN Uniform Fire Code.
 
8.      The trash enclosure must be constructed to match the building.  
 
9.      The following landscaping and sizes will need to be shown on the landscape plan to meet the requirements of the Zoning Ordinance and Highway 65 Overlay:
 
Overstory Trees
9 (2 ½ " caliper) and 3 (3" caliper)=12
Conifer Trees
4 (6' in height) and 2 (8' in height)=6
Ornamental Trees
4 (2" caliper) and 2 (2 ½" caliper)=6
 
10.      All necessary cross-access and maintenance agreements to be executed and maintained to support the shared access and drives.
