Background
The Public Hearing was conducted on September 1, 2011. No questions from the public were received. The vacation of drainage and utility easement for Lot 3, Block 2, the Sanctuary 5th Addition will allow Megan Bautch to construct a pool in the rear yard on a portion of the property that is no longer considered a wetland The applicant is a single property owner who represents 100% of the affected property abutting this easement.
Ordinance No. 11-2234 was introduced for first reading at the September 1, 2011 Council meeting and is presented at this time for adoption.

THE CITY OF BLAINE DOES ORDAIN: Chapter 192 is adopted as an Ordinance of the City of Blaine to read: (Added portions are underscored and deleted portions are shown in brackets with overstrike.)
Chapter 192 - Vacation of Drainage and Utility Easement
192.01 - Commencing at the southeast corner of Lot 3, Block 2, THE SANCTUARY FIFTH ADDITION, Anoka County, Minnesota; thence on an assumed bearing of North 50 degrees 02 minutes 12 seconds West, along the south line of said lot 3, a distance of 97.48 feet to the point of beginning of the area to be vacated; thence North 45 degrees 49 minutes 02 seconds East 84.54 feet; thence North 64 degrees 40 minutes 19 seconds West 3.26 feet; thence South 79 degrees 28 minutes 45 seconds West 53.58 feet; thence South 17 degrees 06 minutes 10 seconds West 45.51 feet to said south line of Lot 3; thence South 50 degrees 02 minutes 12 seconds East along said south line a distance of 10.94 feet to the point of beginning, except for the 5.00 feet lying northerly of and adjacent to said south lot line of Lot 3.
192.02 - Said vacation has been made after Notice of Public Hearing in conformance with Minnesota Statutes and pursuant to Chapter 12, Section 12.06, of the City Charter of the City of Blaine.
