GRANT A PERMANENT BUFFER EASEMENT ON 11980 LEXINGTON AVENUE TO RICE CREEK WATERSHED DISTRICT
Background
As a part of the Rice Creek Watershed District (RCWD) permit that was required to construct the parking lot for the Blaine Wetland Sanctuary, RCWD rules require a permanent buffer easement be dedicated over the wetland area on the City owned parcel at 11980 Lexington Avenue. This easement covers the parcel from the parking lot to the west property line near Judicial Ditch 53-62. This easement is to allow RCWD to enter the area to monitor, modify, and maintain hydrological and vegetative conditions.
The easement does not prohibit the City from the continued restoration efforts in the Blaine Wetland Sanctuary and accounts for the presence of the trail/boardwalk and future trail/boardwalk maintenance. The easement may be amended to redefine the Easement Area in the future.
Recommendation
By motion, authorize the Mayor to sign a permanent buffer easement on 11980 Lexington Ave to allow RCWD to enter the area to monitor, modify, and maintain hydrological and vegetative conditions.
