ORDINANCE AMENDING CHAPTER 14 - ANIMALS ARTICLE IV DOGS AND CHAPTER 54 - PARKS AND RECREATION ARTICLE III CONDUCT IN PUBLIC PARKS OF THE MUNICIPAL CODE OF THE CITY OF BLAINE

 

Background

Staff is bringing forward proposed amendments to establish rules and regulations for the new Aquatore Dog Park.  Below are the rules and regulations that staff is proposing to post at the dog park based on discussions and review of other communities posted rules:

 

OFF - LEASH AREA RULES

Blaine off-leash permit required to enter

Dogs must wear Blaine off-leash tag while in the park

Dogs must be properly vaccinated

Dog owners must pick up and dispose of pet waste in trash receptacle

Dogs must be under control at all times

At the first sign of aggression, dogs must be leashed and removed

Dogs that are declared dangerous are not allowed

Dog owners are liable for damage or injury inflicted by their dogs

Dogs must be leashed when entering or exiting

No more than 3 dogs per handler

Parents must closely supervise children at all times

Dogs in heat are not permitted

No use of tobacco or e-cigarettes

No glass containers

No food except training treats

All personal property, including water jugs, bowls, and toys must be removed daily

No personal furniture allowed

Dog are NOT permitted to dig

Sec. 14-171. - Required; application; procedure.

(a)                     No person shall own any dog within the city limits unless such dog is licensed as provided in this division. Written application for such license shall be made to the city clerk or designee and shall state the name and address of the owner and the breed, color, age and sex of the dog. A license fee shall be paid at the time of making application, a numbered receipt given to the applicant, and a numbered metallic tag shall be issued to the owner. As a condition for the issuance of such license, the owner shall submit a current certificate of rabies vaccination for the dog.  As part of licensure residents will also receive an off-leash permit for any city dog park.  

[(b)] (1) Any dog owner upon first becoming a resident of the city will be allowed 30 days in which to obtain the dog license. The owner of any dog which may be impounded for not being properly licensed within such 30-day period will not be charged with having an unlicensed dog in the city.

[(c)] (2) All dog licenses shall be issued for two or three years beginning with [May] January 1. Application for licenses may be made prior to [June] February 1 without penalty. All applications made after [June] February 1 or more than 30 days after the dog reaches six months of age, or more than 30 days after the dog owner moved into the city, or more than 30 days after the applicant acquires the dog, whichever is the later date, shall be assessed a penalty of $1.00, which amount will be added to and collected with the regular license fee. Any person who acquires a dog after the start of the license period will be allowed 30 days after acquiring such dog to secure a license.

(b)                     No person shall use any city off-leash dog park without a permit as provided in this division. Written application for such off-leash permit shall be made to the city clerk or designee and shall state the name and address of the owner and the breed, color, age and sex of the dog. An off-leash permit fee shall be paid at the time of making application, a numbered receipt given to the applicant shall be issued to the owner. As a condition for the issuance of such permit, the owner shall submit a current certificate of rabies vaccination for the dog.  As part of licensure residents will also receive an off-leash permit for any city dog park.

Sec. 14-172. - Tag.

(a)                     Upon complying with the provisions of sections 14-171 and 14-173, the owner will be issued a numbered metallic, plastic or similar material tag, stamped with the years for which the license/permit is issued. The shape or design of such tag will be changed each license/permit period.

(b)                     Every owner is required to see that the tag is securely fastened to the dog's chain, collar, or harness, which must be worn by the dog at all times.

Sec. 14-173. - Fees; illegal use of receipt or tag.

(a)                     The dog license/off-leash permit fee will be established by action of the council.

(b)                     If the metallic, plastic or similar material license tag or off-leash permit issued for a dog shall be lost, the owner may obtain a duplicate tag, upon the payment of [$1.00] $3.00.

(c)                     If there is a change in ownership of a dog during the license/permit year, the new owner may have the current license/permit transferred to the new owner's name upon the payment of a transfer fee established by action of the council.

(d)                     No person shall use for any dog a license or off-leash permit receipt or license tag or off-leash permit issued for another dog.

(e)                     No refund shall be made of any dog license or off-leash permit fee because of leaving the city or death of the dog before the expiration of the license.

ARTICLE III. - CONDUCT IN PUBIC PARKS

SEC. 54-74. - DOGS TO BE KEPT UNDER RESTRAINT.

 

All dogs, while on designated city park land or open space, shall be under control and on a leash. Dogs shall only be allowed without a physical restrain in city designated "off-leash areas." No person or dog shall violate any posted rule or regulation at city dog parks.
