Background
Kason, Inc. is requesting approval of a comprehensive land use amendment, rezoning, preliminary plat and conditional use permit that would allow the company to construct three apartment buildings on three separate lots in a new development called Emberwood Apartments. This property is located along the frontage road north of the Perkins/multi-tenant retail buildings on the northwest corner of Highway 65 and 125th Avenue. This property was previously the topic of discussion in 2003 when the previous owner received approval to construct a 152 unit senior housing complex on this site. Obviously, that development never came to fruition, but the land use and zoning remained on this property. Most of the property has a current zoning designation of DF (Development Flex) and a land use of HDR (High Density Residential).
Comprehensive Land Use Amendment and Rezoning
There is a portion of this development that still has an underlying commercial land use component and a commercial zoning designation because it was never needed or changed during previous development proposals. This portion of the property is on the northeast corner of the site as shown on the existing zoning/land use exhibit attached to this report. Since a high density residential use is now being proposed for the entire parcel, the commercial land use must be changed to HDR (High Density Residential) and the zoning changed to DF (Development Flex) to be consistent with the remainder of the development.

Body
WHEREAS, Minnesota Statutes, Chapter 462.355, Subdivision 2, prescribes the procedure for amending the Comprehensive Plan; and
WHEREAS, the Planning Commission held a public hearing on March 11, 2014, and recommended denial regarding the Comprehensive Plan amendment request for:
THE S 127.2 FT OF N 256.5 FT OF E 284 FT OF SE1/4 OF SW1/4 OF SEC 5 TWP 31 RGE 23, EX RD, SUBJ TO EASE OF REC; AND
THE S 96.3 FT OF N 129.3 FT OF E 284 FT OF SE1/4 OF SW1/4 OF SEC 5 TWP 31 RGE 23, EX RD, SUBJ TO EASE OF REC
WHEREAS, the City Council has reviewed the Comprehensive Plan amendment request and finds the change to be in general conformance to the adopted Comprehensive Plan for land use compatibility.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that the land use plan be amended to change portions of the property, as described above, and based on land use maps contained within Case File No. 14-0002, from CC to HDR.
