RECEIVE PETITION AND ORDER PUBLIC HEARING FOR VACATION OF DRAINAGE AND UTILITY EASEMENTS ON LOT 4, BLOCK 1, APRIL RIDGE 4TH ADDITION, VACATION NO. V20-05

 

Background

The City received a petition dated July 7, 2020 from Bryce Willaby on behalf of Hogan Real Estate, requesting the vacation of drainage and utility easements on Lot 4, Block 1, April Ridge 4th Addition.  The vacation is necessary as the location and depth of the existing utility within the existing easement can be maintained within a reduced easement width; therefore, the east portion is to be vacated.  The applicant represents 100% of the affected property abutting these easements.

Recommendation

By motion, adopt the Resolution.

 

Body

WHEREAS, the City Council has received a petition dated the 7th day of July 2020, requesting vacation of drainage and utility easements in April Ridge 4th Addition; and

 

                     WHEREAS, the Engineering Department has reviewed the petition and recommends that the City Council hold a Public Hearing on the requested vacation.

 

                     NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine as follows:

 

1.                     The Council will consider the petitioned vacation of easements for the property owner.

 

2.                     A Public Hearing shall be held on the proposed vacation at 7:30 PM on the 9th day of September, 2020 and the City Clerk shall give mailed and published notice of such hearing and vacation as required by law.
