Background
Kason, Inc. is requesting approval of a comprehensive land use amendment, rezoning, preliminary plat and conditional use permit that would allow the company to construct three apartment buildings on three separate lots in a new development called Emberwood Apartments.  This property is located along the frontage road north of the Perkins/multi-tenant retail buildings on the northwest corner of Highway 65 and 125th Avenue.  This property was previously the topic of discussion in 2003 when the previous owner received approval to construct a 152 unit senior housing complex on this site.  Obviously, that development never came to fruition, but the land use and zoning remained on this property.  Most of the property has a current zoning designation of DF (Development Flex) and a land use of HDR (High Density Residential).  
 
Preliminary Plat
The preliminary plat consists of 3 new lots, all over 2 acres in size.  Each lot will contain one apartment building.  
 
Park dedication must be paid for each unit that is constructed on the property.  The 2014 park dedication rate for residential units is $3,094 per unit.  For 147 units, the total amount of park dedication due for this project, if all units are constructed in 2014 would be $454,818.  It is expected that this fee will go up by 10 percent in 2015, so it is likely that the developer will be required to pay park dedication at the new rate in 2015 since construction (building permit) will not likely occur in 2014.  Park dedication payment will be due prior to permits being issued for each building.  This may spread the payment out over several years as this project is proposed in phases, as described later in the report.  This also may change the total amount of park dedication fees received for this development as the park dedication fees may be increased even further in the future.  
 
The plat will need to dedicate a 10 foot strip of right of way along the southern portion of the service drive.  This will allow for a boulevard and snow storage for the existing frontage road.
 
Coon Creek Watershed review and permit is required prior to any activity occurring on site.

      WHEREAS, the Blaine Planning Commission has reviewed said case file on March 11, 2014; and
 
      WHEREAS, the Blaine Planning Commission has recommended subdivision Case File No.14-0002 be denied; and
 
      WHEREAS the Blaine City Council has reviewed said case file on November 20, 2014, December 4, 2014 and December 18, 2014.
 
      NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that preliminary plat approval per Section 74-42 of the subdivision regulations is hereby granted for Emberwood Apartments Addition permitting preparation of a final plat for approval per Section 74-43 subject to the following conditions:
 
1.      Park dedication must be paid for each unit that is constructed on the property.  The 2014 park dedication rate for residential units is $3,094 per unit.  For 147 units, the total amount of park dedication due for this project, if all units were to be constructed in 2014 would be $454,818.  The park dedication payment will be calculated and due with building permits issued for each building at the park dedication rate at the time of permit.
2.      The plat will need to dedicate a 10 foot strip of right of way along the southern portion of the service drive.
3.      Coon Creek Watershed review and permit is required prior to any activity occurring on site.  
4.      The Mayor, City Clerk and City Manager are hereby authorized to execute any and all necessary documents, agreement and releases related to the approval, recording or administration of Emberwood Apartments Addition.
