Background

The applicant represents two adjacent parcels, 8779 Ghia Street NE (Parcel A) and a Homeowners Association common lot (Parcel B).  He would like to construct a deck that is twelve feet wide resulting in a 3-foot setback. The State Building Code however requires a minimum five foot setback from the property line unless the deck is fire rated. The applicant has chosen instead to request a lot line adjustment to create an additional 2 feet of lot width. 

 

The existing drainage and utility easement located on the northeast property line of 8779 Ghia Street NE will need to remain in place.  Parcel A will need to retain the underling drainage and utility easement and be called out as such.

 

This is a very simple request for a waiver of platting and the conditions you see listed below are conditions listed for similar approvals that have been granted in the past.

                     WHEREAS, an application has been filed by Mark of Excellence Homes as Waiver of Platting Case No. 15-0044 and;

 

                     WHEREAS, said case involves the division of a parcel into two separate lots, Anoka County, Minnesota, described as follows:

 

                     CURRENT DESCRIPTION

LOT 19, BLOCK 1, WESTON WOODS ON RICE CREEK, ANOKA COUNTY, MINNESOTA.

 

                     PARCEL A

A 2 FOOT WIDE STRIP OF LOT 19, ADJACENT TO AND ADJOINING THE NORTHEASTERLY LINE OF LOT 7, AND LYING BETWEEN THE NORTHEASTERLY EXTENSIONS OF THE NORTHWESTERLY AND SOUTHEASTERLY LINES OF SAID LOT 7, BLOCK 1, WESTON WOODS ON RICE CREEK, ANOKA COUNTY, MINNESOTA.

 

                     PARCEL B

LOT 19, EXCEPT A 2 FOOT WIDE STRIP OF LOT 19, ADJACENT TO AND ADJOINING THE NORTHEASTERLY LINE OF LOT 7, AND LYING BETWEEN THE NORTHEASTERLY EXTENSIONS OF THE NORTHWESTERLY AND SOUTHEASTERLY LINES OF SAID LOT 7, BLOCK 1, WESTON WOODS ON RICE CREEK, ANOKA COUNTY, MINNESOTA.

 

                     WHEREAS, the City Council of the City of Blaine has reviewed said case on July 9, 2015.

 

                     NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that a Waiver of Platting per Section 18-9(B)(2) of the Subdivision Ordinance is hereby granted to Mark of Excellence Homes allowing to record the above described division with the Anoka County Recorder’s Office, based on the following conditions:

 

1.                     The applicant must record the waiver of platting with Anoka County along with a lot combination adding the 2-feet gained from Lot 19 to Lot 7.

2.                     Parcel A will need to retain the underlying drainage and utility easement along the newly created northeast property line of 8779 Ghia Street NE.

3.                     The Mayor, City Manager and City Clerk are hereby authorized to execute any and all documents necessary for the recording and administration of this land division.
